Regarding this issue, LawNet responded as follows:

1. Subjects of application for preferential allowance for teachers in Vietnam

Subjects of application for preferential allowance for teachers are specified in Clause 1, Section 1 of Joint Circular 01/2006/TTLT-BGD&DT-BNV-BTC as follows:

(1) Teachers (including those during the probationary period, contract) who are on the payroll and are directly teaching in public educational institutions belonging to the national education system and schools, centers, and academies belonging to state agencies, the Party, and socio-political organizations (hereinafter referred to as public educational institutions) be funded by the State for operation (including revenues from the state budget and non-business revenues as prescribed by law);

(2) Teachers (including those during probationary periods or contracts) on the payroll of public educational institutions are in charge of the team, guiding practice at school workshops, stations, camps, and laboratories;

(3) Managers who are on the payroll of public educational institutions and directly teach for a full number of hours as prescribed by competent authorities.

2. Preferential allowance for teachers in 2023 in Vietnam

According to Clause 1, Section 2 of Joint Circular 01/2006/TTLT-BGD&DT-BNV-BTC, the preferential allowances for teachers are as follows:

- The 25% allowance applies to teachers who are directly teaching in universities, colleges, academies, training schools of ministries, ministerial-level agencies, Government agencies, Party organizations, socio-political organizations at the Central level and political schools of provinces and centrally run cities (except teachers teaching in pedagogical schools, pedagogical faculties, and teachers teaching Marxist-Leninist science, Ho Chi Minh Thought);

- The 30% allowance applies to teachers who are directly teaching in junior high schools, high schools, general technical - vocational centers, continuing education centers, vocational training centers in deltas, cities, and towns; professional high schools, vocational schools; political training centers in districts, towns, and cities directly under the province;

- The allowance of 35% applies to teachers who are directly teaching in preschools and primary schools in the delta, cities, and towns; lower secondary schools, upper secondary schools, general technical centers - vocational guidance, continuing education centers, vocational training centers in mountainous, islandous, deep-lying, and remote areas;

- The 40% allowance applies to teachers who are directly teaching in pedagogical schools, pedagogical faculties (universities, colleges, and high schools), schools of education and training administrators, and political teachers in professional secondary schools and vocational schools;

- The allowance of 45% applies to teachers who are directly teaching Marxist-Leninist science subjects, Ho Chi Minh Thought in universities and colleges;

- The 50% allowance applies to teachers who are directly teaching in preschools and primary schools in mountainous, islandous, deep-lying, and remote areas.

The determination of mountainous areas shall comply with the provisions of the Committee for Ethnic Minorities; the island area shall be determined according to geographical reality; and remote and deep-lying areas, depending on the characteristics of each locality, shall be guided by the provincial People's Committees after obtaining the consensus of the Inter-Ministry.

3. Conditions for receiving preferential allowances for teachers in 2023 in Vietnam

- The subjects specified in Section 1 above have been transferred and ranked according to Decree 204/2004/ND-CP on the salary regime for cadres, civil servants, public employees, and armed forces entering the ranks of public employees specialized in education and training (the ranks with the first 2 digits of the rank code are 15) or public employees specialized in education and training (classes with the first letters of the class code V.07) are entitled to preferential allowances.

Particularly, the subjects specified in (2) and (3) of Section 1 above are not necessarily classified into the ranks of public employees specialized in education and training or classes of specialized officials in education and training;

- The subjects specified in Section 1 are not eligible for preferential allowances in the following cases:

+ The period of going on a business trip, working, or studying abroad is entitled to 40% of the salary as prescribed in Clause 4, Article 8 of Decree 204/2004/ND-CP;

+ Time to work or study in the country without participating in teaching continuously for more than 3 months;

+ The period of personal leave without salary continuously for 01 month or more;

+ The period of sick and maternity leave exceeds the time limit prescribed in the current Social Insurance Charter;

+ The period of suspension of teaching.
