According to current regulations in Vietnam, what activities are real estate trading floors allowed to conduct? Which document regulates this issue?

Article 56 of the Real Estate Business Law 2023 stipulates the activities of the real estate trading floor:
- Checking the legal status and conditions for business of real estates introduced through the real estate trading floor; listing, providing real estate information that meets the business conditions as regulated by the Real Estate Business Law 2023.
- Providing services, support, and information to assist customers in searching for and selecting real estate.
- Conducting real estate brokerage services, assisting parties in negotiating real estate transactions. Real estate brokerage activities within the floor must meet the conditions and comply with the regulations in Section 2, Chapter VII of the Real Estate Business Law 2023.
- Providing services and support for parties to draft and conclude real estate transaction contracts.
- Facilitating payment, delivering documents, and handing over real estate (if any) in transactions conducted through the real estate trading floor.
- Storing information, records, and documents concerning real estates and real estate transactions conducted via the trading floor.
- Providing services and supporting other related contents in transactions through the real estate trading floor.
- Confirming transactions through the real estate trading floor; providing information about transactions through the real estate trading floor to provincial real estate business management authorities.
The operating conditions of the real estate trading floor in 2025 are detailed in Article 15 of Decree 96/2024/ND-CP as follows:
(1) The real estate trading floor must meet the conditions stipulated in Article 55 of the Real Estate Business Law 2023, specifically:
- The manager and operator of the real estate trading floor must comply with the following conditions:
+ Have the right to manage enterprises in Vietnam as regulated by the Enterprise Law 2020;
+ Completed training in managing and operating a real estate trading floor and obtained a certificate from a training institution.
- Organizations and individuals conducting real estate trading floor services must establish a real estate service enterprise as regulated in Clause 5, Article 9 of the Real Estate Business Law 2023;
- The name of the enterprise providing real estate trading floor services, chosen by the organization or individual establishing it, must comply with the Enterprise Law 2020 and include the phrase “real estate trading floor”, not overlapping or causing confusion with other registered service enterprises.
- Before operation, the real estate trading floor must submit a dossier to the local state management agency managing real estate businesses to obtain an operation license.
- The real estate trading floor must issue and publicize its real estate transaction procedures.
- The real estate trading floor must register a fixed operating location, have adequate facilities, and technical infrastructure to perform its activities.
(2) The legal representative of the enterprise and the real estate trading floor manager must be responsible for the floor's operations. The legal representative can also be the manager of the trading floor.
(3) The real estate trading floor must have a stable name, address of operation for over 12 months, and technical equipment meeting the requirements of its activities.
(4) The real estate trading floor has a responsibility to implement anti-money laundering measures and report on anti-money laundering as per the legal regulations on anti-money laundering.
