Regarding this issue, LawNet would like to answer as follows:

1. Criteria for determining railway traffic accident black spots in Vietnam

According to Article 6 of Decree 65/2018/ND-CP, railway traffic accident black spots are determined based on the number and level of damage caused by railway traffic accidents that have occurred within 12 months from the time of the last accident in the following cases: :

- Location where 01 or more serious accident occurred.

- Locations where 02 or more serious accidents occurred.

- Locations where 03 or more less serious accidents occurred.

2. Criteria for determining potential railway traffic accident points in Vietnam

According to Article 7 of Decree 65/2018/ND-CP, potential railway traffic accident points are determined based on the current status of railway works, railway traffic safety corridors, the number of cases, and the level of damage caused by railway traffic accidents that have happened within 12 months from the time of the last accident, in the following cases:

- There has been at least 01 accident with a fatality or at least 02 accidents with only injured people, but not to the extent of being identified as a railway traffic accident black spot.

- The current status of works, railway traffic safety corridors, and traffic organization have factors causing railway traffic insecurity, including:

+ The vehicle driver's visibility is limited;

+ Crossroads do not meet technical requirements; the distance between crossroads does not comply with the regulations of the Minister of Transport;

+ Railway traffic safety corridors are violated or pass through densely populated areas;

+ Areas with many self-opening paths through railways and other potentially unsafe locations.

3. Regulations on management of dangerous locations for railway traffic safety in Vietnam

According to Article 8 of Decree 65/2018/ND-CP, the management of dangerous locations for railway traffic safety is as follows:

- The Provincial People's Committee, where there is a dangerous position for railway traffic safety, is responsible for:

+ Preside over organizing monitoring, analysis, cataloging, and a roadmap for eliminating and implementing measures to ensure railway traffic safety at dangerous positions for railway traffic safety on national railways and specialized railways within the scope of management;

+ Organize and manage dangerous positions for railway traffic safety in accordance with the provisions at Point a, Clause 1, Article 8 of Decree 65/2018/ND-CP.

- State management agencies specializing in railway transport are responsible for:

+ Coordinate with the Provincial People's Committee to implement the contents specified in Point a, Clause 1, Article 8 of Decree 65/2018/ND-CP on national railways;

+ Check and propose to the Ministry of Transport measures to ensure railway traffic safety at dangerous crossing locations on the national railway; Propose to the Provincial People's Committee measures to ensure railway traffic safety at the remaining dangerous locations on the national railway;

+ Inspect and direct national railway infrastructure businesses to implement the regulations in Clause 3, Article 8 of Decree 65/2018/ND-CP.

- Railway infrastructure businesses are responsible for:

+ Preside and coordinate with People's Committees at all levels to create a list, roadmap and implement measures to ensure safety at dangerous locations for railway traffic safety on national railways when assigned, leased, or transferred;

+ Manage records, check, and update dangerous positions for railway traffic safety on national railways to serve management work;

+ Propose to state management agencies specializing in railway transport measures to ensure railway traffic safety at dangerous locations on the national railway.

- Owners of specialized railways are responsible for:

+ Preside and coordinate with People's Committees at all levels to make a list, roadmap, and implement measures to ensure safety at dangerous locations for railway traffic safety on specialized railways;

+ Manage records, check, and update dangerous positions for railway traffic safety on specialized railways to serve management work.
