Regarding this issue, LawNet would like to answer as follows:

1. Authority to establish the Arts Council in the field of Performing Arts in Vietnam

The Arts Council shall be established under the decision of the head of a competent agency or unit, including:

- The State-level Arts Council is established by the decision of the Minister of Culture, Sports, and Tourism, with a minimum of 09 members;

- The Arts Council of a province or centrally run city is established under the decision of the President of the People's Committee of the province or centrally run city, with a minimum of 09 members;

- The Art Council of the Department of Performing Arts is established by decision of the Director of the Department of Performing Arts, with a minimum of 07 members;

- The Arts Council of the Department of Culture, Sports, and Tourism is established by the decision of the Director of the Department, with a minimum of 07 members;

- The Art Council of the Central and Local Specialized Literature and Arts Association, elected by the Association's Executive Committee and decided to establish by the Association's President, with 07 members or more;

- The art council of central and local art units and art units of the armed forces shall be established by the decision of the head of the unit with 05 members or more.

2. Functions of the Arts Council in the field of Performing Arts in Vietnam

- The Arts Council performs the function of advising and advising on the ideology, content, form, and quality of art for agency leaders, units for the staging, publication, and dissemination of works, art programs, fashion shows, beauty contests, and models, circulation, trading in phonograms, music, dance, and theater recordings; and proposes solutions on management, composition orientation, improvement of art quality, ideological content, and form of expression of art works and programs in the field of performing arts.

- Specific functions of each Art Council:

+ State-level Arts Council advises on the ideology, content, form, and quality of art programs, scripts,
works of units, organizations, and individuals in the field of performing arts on a national scale.

+ The Arts Council of provinces and centrally-run cities advises on the ideology, content, form, and quality of art programs, scripts, and works of units, organizations, and individuals in the field of performing arts on a scale of provinces and centrally run cities.

+ The Arts Council of the Department of Performing Arts advises on the ideology, content, form, and quality of art programs, scripts, and works of units, organizations, and individuals in the field of performing arts according to their competence or as authorized by the Ministry of Culture, Sports, and Tourism.

+ The Arts Council of the Department of Culture, Sports, and Tourism advises on the ideology, content, form, and quality of art programs, scripts, and works of units, organizations, and individuals in the field of performing arts within the province or a centrally run city according to their competence or as authorized by the provincial People's Committee.

+ The Arts Council of specialized literary and artistic associations at the central and local levels to advise on ideas, content, form, and quality of script art, works of organizations and individuals directly under the Association; annual awards, and composition contests organized by the Association.

+ The art councils of central and local art units and art units of the armed forces advise on the ideology, content, form, and quality of art programs, scripts, and works of organizations and individuals within the scope of management of the unit.
