Contents of the agreement on telecommunications wholesaling in Vietnam from August 23, 2024

The agreement on telecommunications wholesaling must include at least the following contents:

- Requirements and principles for service provision;

- Procedures and processes for service provision;

- Description of the services to be provided, including technical specifications (including information on network configuration where necessary to effectively utilize network access rights);

- Service quality standards, including at least the quality criteria that have been publicly announced;

- Operational and technical requirements that the purchasing enterprise must comply with to avoid causing damage to the selling enterprise’s network;

- Content on telecommunications interconnection as stipulated by the Ministry of Information and Communications (in case of network leasing);

- Terms on pricing and reconciliation, payment procedures for the use of services;

- Forms of payment for the use of services;

- Procedures for implementing changes (additions, reductions) in services;

- Solutions to ensure infrastructure safety and information security;

- Regulations on information confidentiality and data privacy used during the provision and use of services;

- Other rights and obligations of the purchasing/selling enterprises (if any);

- Regulations on the right to terminate the Agreement, compensation for damages in case one of the enterprises does not perform their commitments in the Agreement;

- Dispute resolution, compensation, complaints;

- Contact information.

Note: The agreement on telecommunications wholesaling must meet the following conditions:

- It must be drafted in writing with full details on pricing, service quality standards, and other conditions and terms of service provision that the selling enterprise is ready to offer to any purchasing enterprise that has a need to make an agreement.

- It must be clearly, consistently, and specifically written in accordance with the exact names of the corresponding services to ensure that the purchasing enterprise only buys wholesale services listed in the State-managed telecommunications service market that they wish to purchase.

More details can be found in Circular 08/2024/TT-BTTTT which comes into force in Vietnam from August 23, 2024.
