Vietnam: What is the penalty for failing to bring inland waterway vessel registration certificates?

On December 25, 2015, the Government of Vietnam signed and issued Decree No. 132/2015/ND-CP of Vietnam’s Government stipulating penalties for administrative violations in inland waterway traffic.

According to Clause 2 Article 11 of Decree No. 132/2015/ND-CP of Vietnam’s Government, a fine ranging from VND 100.000 to VND 200.000 shall be imposed for the commission of one of the following violations, applicable to a non-motorized vessel with a deadweight tonnage of between over 01 tonnes and under 15 tonnes or with a capacity of between over 05 passengers and under 12 passengers, a motorized vessel with total main engine capacity of under 05 horse powers or with a capacity of under 05 passengers:

- Failing to bring inland waterway vessel registration certificates;

- Failing to re-register vessels according to regulations or make declaration in order to delete the name of vessel or return inland waterway vessel registration certificates according to regulations;

- Failing to line, attach registration numbers to vessels in accordance with regulations;

- Failing to line load lines to vessels;

Besides, Decree No. 132/2015/ND-CP stipulates that a fine ranging from VND 50.000 to VND 100.000 shall be imposed for the commission of one of the following violations:

a) Failing to line, attach registration numbers to vessels in accordance with regulations;

b) The registration numbers are faded or obscured;

c) The permitted numbers of passengers are faded or obscured;

d) Failing to line load lines in accordance with regulations or ensure that the load lines are not faded or obscured;

dd) Failing to ensure the safety of operation and use of non-motorized vessels with a deadweight tonnage of under 01 tonne or with a capacity of under 05 passengers or a raft.

Relevant provisions can be found in Decree No. 132/2015/ND-CP of Vietnam’s Government, which takes effect from July 01, 2016.
