Vietnam: All penalties for operation and use of vessels exceeding the prescribed use life

This is a notable content mentioned in Decree No. 132/2015/ND-CP of Vietnam’s Government stipulating penalties for administrative violations in inland waterway traffic.

Specifically, according to Article 14 of Decree No. 132/2015/ND-CP of Vietnam’s Government, all penalties applicable to violations against regulations on the use life of vessels are as follows:

- A fine ranging from VND 45.000.000 to VND 55.000.000 shall be imposed for vehicles carrying dangerous goods, oil, liquefied petroleum gas; hovercraft.

- A fine ranging from VND 55.000.000 to VND 65.000.000 shall be imposed for passenger vessels with a capacity of over 12 passengers that are not accommodation vessels, floating restaurants or floating hotels, hovercraft.

- A fine ranging from VND 65.000.000 to VND 75.000.000 shall be imposed for accommodation vessels, floating restaurants or floating hotels.

In addition to fines, individuals and organizations, both Vietnamese and foreign, who commit the above-mentioned violations will also face the additional penalty of "revoking the boat captain's license or certificate of professional competence of the boat captain for a period of 2 to 3 months".

Relevant provisions can be found in Decree No. 132/2015/ND-CP of Vietnam’s Government, which takes effect from July 01, 2016.
