Vietnam: Causing traffic obstruction with vessels shall be fined up to VND 05 million

Recently, the Government of Vietnam signed and issued Decree No. 132/2015/ND-CP of Vietnam’s Government stipulating penalties for administrative violations in inland waterway traffic.

According to Clause 2 Article 6 of Decree No. 132/2015/ND-CP of Vietnam’s Government, a fine ranging from VND 3.000.000 to VND 5.000.000 shall be imposed for the commission of one of the following violations in inland waterways, port waters, landing stages or within the scope of channel protection corridors:

- Failing to notify in writing competent state agencies about the salvage and clearance of obstacles, organization of physical training, training, sports competitions, festivals, recreational activities, drills in inland waterway transport, except for classified defense and security drills;

- Failing to properly implement the traffic safety plan approved by the competent state agencies in inland waterway transport during the construction of projects, salvage and clearance of obstacles, dredging of waterways, dredging of port areas, inland waterway terminals, exploitation of sand, gravel, or other minerals, surveying, exploration, organizing drills, physical training, training, sports competitions, festivals, and recreational activities;

- Causing traffic obstruction with construction vehicles or equipment;

- Failing to remove obstacles after completing construction projects or salvaging sunken vehicles;

- Failing to hand over relevant project documents related to inland waterway transport to the competent state authority upon completion of construction work as regulated.

Thus, any individual or organization, whether Vietnamese or foreign, that obstructs traffic on inland waterways, port areas, or inland waterway terminals with construction vehicles and equipment within the protected passage area shall be fined from VND 3.000.000 to VND 5.000.000.
