On February 11, 2025, the Ministry of Transport issued Official Dispatch 1321/BGTVT-VT to continue the implementation of regulations relating to the operation of four-wheeled vehicles with engines.
To implement the Law on Order and Road Traffic Safety, Road Law, and regulations relevant to the operation of four-wheeled vehicles with engines, the Ministry of Transport has issued Document No. 14330/BGTVT-VT on December 31, 2024, regarding the management of four-wheeled vehicles with engines under the provisions of the Law on Order and Road Traffic Safety and the Road Law.
To ensure proper legal compliance and facilitate organizations and individuals engaging in transport activities using four-wheeled vehicles with engines, the Ministry of Transport requests the People's Committees of provinces and centrally-run cities to urgently implement the following:
- According to Clause 2, Article 48 of the Law on Order and Road Traffic Safety, the responsibilities of provincial-level People's Committees are as follows:
2. The provincial People's Committee determines the time, scope of passenger transport activities by four-wheeled vehicles with engines and goods transport activities by four-wheeled cargo vehicles in the locality.
Based on this, we request the provincial People's Committees and centrally-run cities to evaluate the local situation to determine the scope and set speed limit signs on local roads for organizing the activities of four-wheeled vehicles with engines in compliance with Clause 2, Article 24 of Decree 165/2024/ND-CP and Article 77 of the Law on Order and Road Traffic Safety.
- Increase the dissemination of regulations related to four-wheeled vehicles with engines to organizations and individuals using these types of vehicles at the local level to ensure compliance with legal regulations and ensure traffic safety.
Article 9 of the Law on Order and Road Traffic Safety 2024 stipulates 28 prohibited acts as follows:
(1) Operating motor vehicles on roads without a driving license as required by law; operating specialized motorcycles on roads without a driving license or legal traffic training certificate, or a certificate to operate specialized motorcycles.
(2) Operating vehicles on roads with alcohol content in the blood or breath.
(3) Operating vehicles on roads with narcotics or other stimulants in the body prohibited by law.
(4) Insulting, threatening, obstructing, opposing, or refusing to comply with the orders, guidance, and inspection of officers ensuring road traffic order and safety.
(5) Participating in illegal racing, organizing races, inciting, assisting, or encouraging unlawful racing; operating vehicles on roads while weaving, swerving, or continuously revving the engine.
(6) Using handheld devices and electronic equipment while driving vehicles on the road.
(7) Allowing unauthorized individuals to operate motor vehicles or specialized motorcycles on roads.
(8) Introducing motor vehicles or specialized motorcycles that do not comply with legal safety and environmental protection standards to the road traffic system.
(9) Importing, manufacturing, or assembling motor vehicles or specialized motorcycles that do not meet legal technical safety and environmental protection standards.
(10) Illegally modifying automobiles of another type to passenger cars, except transformations for national defense and security purposes.
(11) Unauthorized alteration; intentionally tampering with distance meter readings; cutting, welding, erasing, engraving, or illegal re-marking chassis numbers and engine numbers of motor vehicles and specialized motorcycles.
(12) Intentionally tampering or changing registered software control of vehicles or engines for fraudulent testing, trial, and registration purposes; leasing or borrowing motor vehicle parts solely for registration.
(13) Transporting goods exceeding the vehicle’s total weight or axle load limits, exceeding the road’s load or size limits when not permitted by the authority or not meeting the requirements as per the Law on Order and Road Traffic Safety 2024; transporting unfastened goods or improperly secured goods; carrying more passengers than permitted by law.
(14) Transporting prohibited goods, illegal transportation or not fully complying with legal regulations regarding dangerous goods transportation, or wildlife.
(15) Threatening, insulting, seizing, soliciting passengers; threatening, forcing passengers into unwanted services; shifting, unloading passengers or other acts to evade detection of overloading vehicles contrary to legal regulations.
(16) Installing or using sound and light equipment on motor vehicles and specialized motorcycles that disrupt road traffic order and safety.
(17) Illegally producing, using, buying, or selling license plates; operating vehicles with unapproved license plates, improperly mounted license plates; bending, covering license plates; altering license plate characters, numbers, color, shape, or size.
(18) Disrupting or tampering with the operation or data integrity of monitoring devices, cameras installed on vehicles according to the Law on Order and Road Traffic Safety 2024.
(19) Destroying, damaging, or disabling traffic control and monitoring equipment, or intelligent devices assisting in road traffic control and direction.
(20) Illegally placing obstacles on roads; scattering sharp objects, spilling slippery substances; dumping rocks, goods, construction materials, waste on roads; releasing hazardous chemicals or waste endangering road safety.
(21) Obstructing individuals and vehicles participating in road traffic; throwing objects at individuals and vehicles on the road.
(22) Taking advantage of, abusing traffic order, and safety tasks to commit illegal acts, harass, or infringe upon State, organizational, or individual rights and interests.
(23) Abusing position, authority, profession for oneself or others to violate road traffic order and safety laws or interfere in handling violations.
(24) Using priority rights illegally during non-urgent duties; installing or using non-compliant priority signal devices.
(25) Providing false information or documentation to evade responsibility when found violating the road traffic order and safety laws.
(26) Fleeing after causing road traffic accidents to avoid responsibility; not aiding accident victims when possible; infringing on the lives, health, property of victims, perpetrators, or helpers; exploiting traffic accidents to assault, intimidate, or manipulate.
(27) Operating flying objects, unmanned aircraft, ultralight vehicles within road clearance limits that obstruct or threaten road traffic safety unless authorized for flight.
(28) Other acts violating road traffic rules as stipulated in Chapter II of the Law on Order and Road Traffic Safety 2024.
