Application for sickness allowances under compulsory social insurance in Vietnam from July 1, 2025

The following article contains information about the application for sickness allowances under compulsory social insurance in Vietnam from July 1, 2025, as stipulated in the Law on Social Insurance 2024.

Law on Social Insurance 2024 was passed by the National Assembly of the Socialist Republic of Vietnam on June 29, 2024.

1. Application for sickness allowances under compulsory social insurance in Vietnam from July 1, 2025

According to the provisions of Article 47 of the Law on Social Insurance 2024, the application for sickness allowances under compulsory social insurance in Vietnam is as follows:

- The Application for sickness allowances for the employee or the employee’s child receiving inpatient treatment includes either the original or a copy of one of the following documents:

+ Hospital discharge paper;

+ Summary of the medical record;

+ Other documents proving the inpatient treatment process.

- The Application for sickness allowances for the employee or the employee’s child receiving outpatient treatment includes one of the following documents:

+ Certificate of leave to enjoy social insurance;

+ The original or copy of the hospital discharge paper indicating the required outpatient treatment period following inpatient treatment;

+ The original or copy of the summary of the medical record indicating the required outpatient treatment period following inpatient treatment.

- The Application for sickness allowances for the employee or the employee’s child receiving medical treatment abroad includes medical documents showing the disease's name and treatment period issued by a foreign medical institution, and must meet the following requirements:

+ Have a certified or notarized Vietnamese translation according to legal regulations on notarization and certification;

+ Be legalized, except in cases where international treaties to which the Socialist Republic of Vietnam is a signatory have different provisions.

- The Minister of Health prescribes the form, process, and authority for issuing documents in the file prescribed in clause 1 and clause 2, Article 47 of the Law on Social Insurance 2024 issued by medical institutions, and prescribes substitute documents in force majeure cases due to natural disasters, catastrophes, or epidemics.

2. Leave period upon sickness of children under compulsory social insurance in Vietnam from July 1, 2025

The leave period upon sickness of children under compulsory social insurance is specifically set out in Article 44 of the Law on Social Insurance 2024 as follows:

- The Leave period upon sickness of children in one year (from January 01 to December 31) is a maximum of 20 days for each child under 03 years old; a maximum of 15 days for each child from full 03 years old to under 07 years old.

- If both parents participate in compulsory social insurance, the duration of social insurance benefits for each person is in accordance with clause 1, Article 44 of the Law on Social Insurance 2024.

- The duration of leave to enjoy social insurance benefits for caring for sick children prescribed in Article 44 of the Law on Social Insurance 2024 is calculated by working days, excluding public holidays, New Year holidays, and weekly rest days.

More details can be found in the Law on Social Insurance 2024 which takes effect from July 01, 2025.

Law on Social Insurance 2014 and Resolution 93/2015/QH13 on the implementation of one-time social insurance policies for employees will cease to be effective from the date the Law on Social Insurance 2024 takes effect in Vietnam.
