1. Conditions for receiving pluralism allowances in Vietnam

According to Clause 1, Article 11 of Circular 13/2019/TT-BNV, commune-level cadres will only be appointed to hold the title of commune-level civil servant when they fully meet the conditions and criteria for the title of commune-level civil servant specified in Decree 92/2009/ND-CP (amended by Decree 34/2019/ND-CP) and Circular 13/2019/TT-BNV.

For commune-level cadres and civil servants who concurrently hold a position can reduce 01 person from the maximum number specified in Clause 1, Article 4 of Decree 92/2009/ND-CP (amended by Decree 34/2019/ND-CP), from the day on which the competent authority decides on the part-time job, they shall be entitled to a part-time allowance consisting of: 50% of the salary (level 1), plus the allowance for the leadership position (if any) of the part-time position.

Currently, the number of commune-level cadres and civil servants is arranged according to the Decision on classification of administrative units into communes, wards, and townships. As follows:

- Type 1: up to 23 people;

- Type 2: up to 21 people;

- Type 3: up to 19 people.

Commune-level cadres and civil servants may concurrently hold the title of part-time worker at commune level.

* Note: In the case of simultaneously holding multiple positions (including the case where the Secretary of the Party Committee is also the Chairman of the People's Committee, and the Secretary of the Party Committee is also the Chairman of the People's Council), only one part-time allowance will be paid.

2. Pluralism allowances for commune-level cadres and civil servants in Vietnam

Clauses 2 and 3, Article 11 of Circular 13/2019/TT-BNV stipulates the allowance for concurrently holding positions for commune-level cadres and civil servants as follows:

- Clause 1 of Article 10 of Decree 92/2009/ND-CP (amended by Decree 34/2019/ND-CP) specifies the level of part-time allowance for commune-level cadres eligible for part-time allowance as follows:

+ Commune-level cadres who arrange salaries in accordance with the salary table of positions while also holding the position of commune-level cadres are entitled to a part-time allowance equal to 50% of the level 1 salary of the part-time position.

+ Commune-level cadres who are paid as administrative civil servants and receive allowances for leadership positions while holding the position of commune-level cadres are entitled to a part-time allowance equal to 50% of the salary level 1 of the administrative civil servant ranks being ranked plus the allowance for the leading position of the part-time position.

+ Commune-level cadres who concurrently hold the title of commune-level civil servant shall be entitled to a part-time allowance equal to 50% of the salary of grade 1 of the assigned administrative civil servant rank of commune-level cadres who are assigned part-time.

- Commune-level cadres and civil servants who concurrently hold the title of part-time employee at the commune level are entitled to a part-time allowance.

The level of allowance for part-time positions of part-time workers at the commune level shall be submitted by the provincial-level People's Committees to the People's Councils of the same level.

* Note: The allowance for part-time positions is not used to calculate the payment of social insurance and health insurance benefits. (Clause 3, Article 10 of Decree 92/2009/ND-CP (amended by Decree 34/2019/ND-CP))

3. Current commune-level civil servant titles in Vietnam

Commune-level civil servants have the following titles according to Clause 2, Article 3 of Decree No. 92/2009/ND-CP:

- Police chief;

- Military commander;

- Office – statistics;

- Cadastral - construction - urban and environment (for wards and townships) or cadastral - agriculture - construction and environment (for communes);

- Accouting financial;

- Justice - civil status;

- Sociocultural.
