On November 20, 2019, the National Assembly of Vietnam officially signed for the promulgation of the Labor Code 2019 to replace the Labor Code 2012. The Labor Code 2019 will come into force on January 01, 2021 with many important changes that directly benefit workers, including significant changes to labor outsourcing contracts.
On December 14, the Government of Vietnam issued the Decree No 145/2020/NĐ-CP on elaboration of some articles of the Labor Code on working conditions and labor relations in Vietnam.
Labor outsourcing is an arrangement in which a worker enters into an employment contract with an outsourcing enterprise, which subsequently dispatches the worker to work for another employer while maintaining labor relations with the outsourcing enterprise with which the employment contract is concluded.
