Regulations on promotion consideration for officials with achievements in civil service in Vietnam

According to Article 31a of Decree 138/2020/ND-CP (supplemented in Decree 116/2024/ND-CP), the guidance on promotion consideration for officials with achievements in civil service in Vietnam is as follows:

(1) Rank promotion from employee or equivalent to officer or equivalent; from officer or equivalent to specialist or equivalent if they meet one of the following conditions:

- Awarded a commendation from the Ministry, committee, department, province or higher for achievements in work and evaluated and classified as having completed duties well or better in the year immediately preceding the year of rank promotion consideration;

- In the three years immediately preceding the year of rank promotion consideration, they must be evaluated and classified in quality at the level of completing duties well or better, including at least one year rated at the level of completing duties excellently.

(2) Rank promotion from specialist or equivalent to senior specialist or equivalent if they meet one of the following conditions:

- Awarded the Third-Class Labor Medal or higher and evaluated and classified in quality at the level of completing duties well or better in the year immediately preceding the year of rank promotion consideration;

- Awarded the Prime Minister's Commendation and in the three years immediately preceding the year of rank promotion consideration, evaluated and classified in quality at the level of completing duties well or better;

- Awarded the title of emulation soldier by the Ministry, committee, department, province or higher and in the three years immediately preceding the year of rank promotion consideration, evaluated and classified in quality at the level of completing duties well or better, including at least one year rated at the level of completing duties excellently.

(3) Rank promotion from senior specialist or equivalent to principal specialist or equivalent if they meet one of the following conditions:

- Awarded the Second-Class Labor Medal or higher and in the three years immediately preceding the year of rank promotion consideration, evaluated and classified in quality at the level of completing duties well or better, including at least one year rated at the level of completing duties excellently;

- Awarded the title of National Emulation Soldier.

(4) In cases where a department, organization, or unit has a higher number of officials eligible for rank promotion based on achievements in public service than the approved official rank structure, the determination of officials to be considered for rank promotion is done in the following priority order:

- Officials with higher commendations; if equal, consider officials with more commendations during the rank holding period;

- Officials with higher emulation achievements; if equal, consider officials with more emulation achievements during the rank holding period;

- Female officials;

- Officials from ethnic minorities;

- Older officials (based on birth date, month, and year);

- Officials with longer working periods.

If still unable to determine the individuals to be considered for rank promotion, the competent authority managing or authorized to appoint ranks will consider and decide.

Principles for considering official rank promotion in Vietnam from September 17, 2024

The consideration for official rank promotion from September 17, 2024, must adhere to the principles stipulated in clause 2 of Article 31 Decree 138/2020/ND-CP (amended in Decree 116/2024/ND-CP). To be specific:

- Only promote to the next higher immediate rank. If the achievement is higher than required for the next higher immediate rank, only promotion to the next higher immediate rank is allowed, and such achievement cannot be used for subsequent promotions.

- The rank promotion consideration for officials with achievements in public service must ensure alignment with the official rank structure of the employing agency as approved by the competent authority; the achievement standards must be within the period of holding the current official rank and ensure officials are assigned to work positions suitable with the rank being considered.

- The rank promotion consideration for officials appointed to leadership and management positions must be tied to the requirements of the job positions approved by the competent authority managing officials.
