Main Content of the Law on Thrift Practice and Waste Prevention

On November 26, 2013, the National Assembly issued Law No. 44/2013/QH13 on Thrift Practice and Waste Combat. The law consists of 5 chapters and 80 articles that stipulate the practice of thrift and the combat against waste in: the management and use of the state budget, state capital, state assets, labor, and working time in the public sector; the management, exploitation, and use of resources; production, business activities, and consumption of organizations, households, and individuals.

Subjects of the Law include: agencies, organizations, and individuals managing and using the state budget, state capital, state assets, labor, and working time in the public sector; agencies, organizations, households, and individuals managing, exploiting, and using resources; other organizations, households, and individuals.

Principles of thrift practice and anti-waste include: practicing thrift and anti-waste is a regular task from policy directions, policy mechanisms to implementation associated with inspection and supervision; practicing thrift and anti-waste must be based on standards, norms, policies, and other legal regulations; practicing thrift and anti-waste must be linked with administrative reform and ensuring the completion of assigned tasks without affecting the normal functioning of agencies and organizations; implementing management decentralization, closely coordinating between levels, sectors, agencies, and organizations in fulfilling assigned tasks associated with the responsibility of the head, the responsibility of officials and public employees in agencies, organizations to practice thrift and anti-waste; ensuring democracy, openness, and transparency; ensuring the supervisory role of the National Assembly, People's Councils at all levels, the Vietnam Fatherland Front, member organizations of the Vietnam Fatherland Front, and the people in practicing thrift and anti-waste.

Disclosure on practicing thrift and anti-waste includes: publicizing the management and use of the state budget, state capital, state assets, labor, working time, and resources as a measure to ensure practicing thrift, preventing, and avoiding waste. Except for areas and activities related to state secrets, the following areas and activities must be publicized: estimates, allocation, adjustment of estimates, and settlement of the state budget of agencies and organizations using the state budget; funds sourced from the state budget; fundamental construction investment, procurement, management, and use of assets in agencies, organizations using the state budget; revenue into the state budget, capital mobilization for the state budget, and state credit; funds mobilized from domestic and foreign contributions; public debt according to the Law on public debt management; economic-social development planning; sector and regional development planning; land use planning; urban planning, planning, and project investment list, investment capital sources; construction planning; planning and activities exploiting resources; norms, standards, policies stipulated or applied by agencies, organizations; financial management regulations, internal expenditure of agencies, organizations; sectorial and field standards; allocation and use of labor resources; programs and plans to practice thrift and anti-waste; results of practicing thrift; wasteful acts and results of dealing with wasteful acts; procedures for solving work between state agencies and organizations, individuals; other fields as prescribed by law.

Forms of disclosure include: issuing publications; announcements on mass media; written notifications to relevant agencies, organizations, individuals; posting on the electronic information page; announcing at meetings, posting at the workplace of agencies, organizations; providing information upon request of relevant agencies, organizations, individuals. In addition to mandatory public forms as prescribed by law, the head of the agency, organization is responsible for selecting one or a number of forms of disclosure for each field of activity in accordance with Clause 3 of this Article. The Government of Vietnam stipulates in detail the forms, content, and timing of disclosure.

Citizens have the right to supervise the practice of thrift and anti-waste through denunciation, complaints, accusations, or through the Vietnam Fatherland Front, member organizations of the Vietnam Fatherland Front; detect and promptly report to competent organizations or individuals about wasteful acts. The National Assembly, the Standing Committee of the National Assembly, agencies of the National Assembly, the Delegation of National Assembly Deputies, and National Assembly deputies supervise the practice of thrift and anti-waste according to the Law on supervision activities of the National Assembly. People's Councils at all levels, People's Council representatives supervise the practice of thrift and anti-waste at the local level as prescribed by law. The Vietnam Fatherland Front and its member organizations, the People's Inspection Board, and the Community Investment Supervision Board supervise the practice of thrift and anti-waste according to the provisions of the law.

Regulations on practicing thrift and anti-waste in several areas: practicing thrift and anti-waste in the issuance, implementation of standards, norms, policies; in preparing, appraising, approving estimates, settlement, management, and use of state budget funds; in procurement, use of means of transport and working facilities of agencies, organizations in the public sector; managing and using state capital and assets in enterprises; production, business activities, and consumption of the people.

This Law takes effect from July 1, 2014.
