From January 1, 2016, the Law on the Organization of the National Assembly 2014 began to take effect. It has the following notable points.
1. Clear Distinction of Activity Time for Full-time and Part-time Delegates
- Full-time National Assembly delegates dedicate all their working time to performing the duties and exercising the powers of a delegate at the National Assembly's bodies or at the Provincial National Assembly Delegation.- Part-time National Assembly delegates must dedicate at least one-third of their working time annually to performing the duties and exercising the powers of a National Assembly delegate.
2. New Powers of National Assembly Delegates
- The right to participate as a member and engage in the activities of the Ethnic Council, Committees of the National Assembly. National Assembly delegates who are not members of the Ethnic Council or Committees have the right to register to attend meetings organized by the Council or Committees to discuss contents of interest to the delegates.- The right to stand for election or to nominate candidates for positions elected by the National Assembly. Nominees have the right to withdraw their names from the candidate list.
3. Additional Provisions for Ensuring Conditions for National Assembly Delegates
In addition to the guarantees as per the Law on the Organization of the National Assembly 2001, the following conditions are supplemented:
- The time in a year that part-time National Assembly delegates dedicate to performing their delegate duties as specified in Clause 2, Article 24 of this Law is counted as working time at the agency, organization, or unit where the delegate works.- National Assembly delegates are given priority when purchasing train, bus, boat, and airplane tickets; and when crossing bridges and ferries.- In case of illness, National Assembly delegates who are not in the middle-ranking or higher-level cadre category are entitled to medical examination and treatment under the standards for middle-ranking cadres.- National Assembly delegates and former delegates who are not officials and public employees are entitled to funeral organization policies equivalent to those for officials upon their death.
4. Allowances and Other Policies for National Assembly Delegates
- Specific regulations on allowances and other policies for National Assembly delegates.- Allowances and other policies for full-time National Assembly delegates, and allowances for delegates not receiving a salary from the state budget are stipulated by the National Assembly Standing Committee.- National Assembly delegates are provided a monthly operational allowance, funds for policy implementation, hiring specialist lease contracts, secretaries to assist in their work, and other activities to support the delegates' functions as regulated by the National Assembly Standing Committee.
5. Coordination of Work Between the National Assembly Standing Committee and Agencies, Organizations, Units, and Individuals
- When performing their duties and exercising their powers, the National Assembly Standing Committee coordinates with the President, the Government of Vietnam, the Prime Minister of the Government of Vietnam, the Supreme People's Court, the Supreme People's Procuracy, the State Audit Office of Vietnam, the National Election Council, and the Presidium of the Central Committee of the Vietnam Fatherland Front; and can require representatives of other agencies, organizations, and citizens to participate when necessary.- The Government of Vietnam, the Supreme People's Court, the Supreme People's Procuracy, other state bodies, political-social organizations, social organizations, socio-professional organizations, economic organizations, armed forces units, and citizens are responsible for implementing the requests of the National Assembly Standing Committee.
6. Establishment, Dissolution, Merger, Splitting, and Adjustment of Administrative Boundaries Below Provincial Level
- The National Assembly Standing Committee decides on the establishment, dissolution, merger, splitting, and adjustment of administrative boundaries below the provincial level based on proposals from the Government of Vietnam.- Schemes on the establishment, dissolution, merger, splitting, and adjustment of administrative boundaries below the provincial level must be examined by the National Assembly Committee before being submitted to the National Assembly Standing Committee for consideration and decision.
7. Responsibilities of the National Assembly Standing Committee in Organizing Referendums
- The National Assembly Standing Committee organizes referendums as decided by the National Assembly.- The National Assembly Standing Committee regulates the form of referendum ballots, voting procedures, and vote counting; determines the specific time for referendums and the contents recorded on referendum ballots based on the National Assembly's resolution on conducting the referendum; and supervises the referendum process.- The National Assembly Standing Committee is responsible for reporting the referendum results to the National Assembly at the nearest session.
