Vietnam: Propose and consider amending and supplementing a number of articles of Decree No. 100/2019/NĐ-CP

According to Official Dispatch No.  11005/BGTVT-ATGT, to implement the Prime Minister's instructions in the Document No. 1467/TTg-CN on implementing the task of ensuring traffic order and safety in the fourth quarter of 2020, the Ministry of Transport of Vietnam requires agencies and units to focus on implementing the following tasks:

Legal Department: Continue to review and improve the system of legal documents, policy on ensuring traffic safety, focusing on completing the Draft Road Traffic Law (amended) according to the opinion of the 14th National Assembly at its 10th session;

Traffic Safety Department:

- Research and consider proposals to amend and supplement a number of articles of Decree No. 100/2019/NĐ-CP of Vietnam’s Government in the direction of supplementing regulations on penalties for vehicle owners and heads of transport business units who are at fault for causing traffic accidents but not to the extent of being prosecuted for criminal liability;

- Advise the Ministry to drastically direct the work of controlling vehicle load;

Transport Department: Advise the Ministry to direct the implementation of solutions to remove and overcome difficulties and restore growth in transportation business activities;

Department of Transport Infrastructure: Continue to implement maintenance plans to ensure traffic safety for traffic infrastructure, giving highest priority to resources to ensure traffic and overcome damage to traffic infrastructure caused by rain and floods;

​The Ministriterial Inspectorate coordinates with the local Traffic Inspectorate:

- Plan peak inspection and vehicle load checks in some areas, on key national highways where many heavy trucks and overloaded vehicles operate;

- Organize inspection and examination of transport business units in compliance with regulations on road transport business activities and vehicle management.

Vietnam Road Administration:

- Deploy research and apply advanced technology to effectively manage vehicles and drivers of transport business vehicles (in terms of driving time, vehicle itineraries) to provide functional units with handling violations according to regulations;

- Highly concentrate resources (equipment, human resources) to quickly overcome damage caused by rain and floods to transport infrastructure, ensuring safe and smooth traffic on the national highway system;

Departments of Transport of provinces and central-affiliated cities: Give highest priority to resources to ensure traffic and overcome damage to traffic infrastructure caused by rain and floods on locally managed roads; ensure safe and smooth traffic.

Thus, at the request of the Ministry of Transport of Vietnam, in the near future, the Traffic Safety Department will research and consider proposing amendments and supplements to a number of articles of Decree No. 100/2019/NĐ-CP.
