Sanctions for passenger vehicles arbitrarily selling tickets at higher prices than prescribed rates on Tet in Vietnam

This is a notable content mentioned at the Decree No. 100/2019/NĐ-CP of the Government of Vietnam on administrative penalties for road traffic offences and rail transport offences, replacing the Decree No. 46/2016/NĐ-CP.

According to Clause 2 Article 4 of the Joint Circular No. 152/2014/TTLT-BTC-BGTVT, all transport enterprises must carry out posting the fares in public transport stops (or ticket agencies) or in ticket counters for the entrusted routes. However, in fact, the transport operators have arbitrarily increased ticket prices suddenly without posting, causing many difficulties for people. For the act of collecting ticket fees higher than regulations, the Decree No. 100/2019/NĐ-CP of Vietnam’s Government sets out 02 levels of administrative sanctions corresponding to the following 02 subjects:

- Operators of civil and commercial passenger automobiles: shall be fined up to VND 800.000:

Article 23. Penalties imposed upon operators of civil and commercial passenger automobiles, and similar automobiles violating road traffic regulations

3. A fine ranging from VND 600,000 to VND 800,000 shall be imposed for:

l) Operating a fixed-route passenger vehicle and collecting money without giving tickets to passengers, or selling tickets at higher prices than prescribed rates.

- Attendants on passenger vehicles: shall be fined up to VND 400.000:

Article 31. Penalties imposed upon attendants on buses, fixed-route passenger vehicles, contract-based passenger vehicles, and tourist vehicles violating traffic rules

3. A fine ranging from VND 300,000 to VND 400,000 shall be imposed upon an attendant on a fixed-route passenger vehicle that collects money without giving tickets to passengers, or sells tickets at higher prices than prescribed rates.

Thus, if the driver or attendant on passenger vehicles arbitrarily collects a fare higher than the posted price, he shall be fined up to VND 400.000 VND for the attendant and VND 800.000 for the driver.
