The situation of traffic order and safety during Tet is always very complicated with the number of traffic violations increasing dramatically compared to normal days. To prevent this, the Government of Vietnam issued the Decree No. 100/2019/NĐ-CP on administrative penalties for road traffic offences and rail transport offences.

LAWNET would like to send to Customers and Members some common traffic violations during the Lunar New Year 2021 and the corresponding fines for each act according to Decree No. 100/2019/NĐ-CP of Vietnam’s Government, specifically as follows:
1. Turning without slowing down or signaling
Fines:
- For motorcycles: VND 400,000 - VND 600,000 (Point a Clause 3 Article 6).
- For cars: VND 800,000 - VND 1,000,000 (Point c Clause 3 Article 5).
2. Changing lanes without signaling (without turning signal)
Fines:
- For motorcycles: VND 100,000 - VND 200,000 (Point i Clause 1 Article 6).
- For cars: VND 400,000 - VND 600,000 (Point a Clause 2 Article 5). In case of violations on a freeway, fines are VND 3,000,000 - VND 5,000,000 (Point g Clause 5 Article 5).
Additional penalties:
Suspension of driving license from 1 month to 3 months shall be applied for operators of cars violating on a freeway (Point b Clause 11 Article 5).
3. Using a cell phone with hands while operating cars on public roads
Fines: VND 1,000,000 - VND 2,000,000 (Point a Clause 4 Article 5).
Additional penalties: Suspension of driving license from 1 month to 3 months; suspension of driving license from 2 months to 4 months in case causing accident (Points b, c Clause 11 Article 5).
4. Using a cell phone, or audio device other than hearing aid devices while operating motorcycles
Fines: VND 600,000 - VND 1,000,000 (Point h Clause 4 Article 6).
Additional penalties: Suspension of driving license from 1 month to 3 months (Point b Clause 10 Article 6).
5. Running red and yellow lights (if the yellow light is flashing, it is allowed to drive but must slow down)
Fines:
- For motorcycles: VND 600,000 - VND 1,000,000 (Point e Clause 4 Article 6).
- For cars: VND 3,000,000 - VND 5,000,000 (Point a Clause 5 Article 5).
Additional penalties:
- For motorcycles: Suspension of driving license from 1 month to 3 months (Point b Clause 10 Article 6).
- For cars: Suspension of driving license from 1 month to 3 months (Point b Clause 10 Article 6).
6. Going in the wrong lane
Fines:
- For motorcycles:
+ VND 600,000 - VND 1,000,000 (Point g Clause 3 Article 6).
+ VND 4,000,000 - VND 5,000,000 if causing accident (Point b Clause 7 Article 6).
- For cars:
+ VND 3,000,000 - VND 5,000,000 (Point dd Clause 5 Article 5).
+ VND 10,000,000 - VND 12,000,000 if causing accident (Point a Clause 7 Article 5).
Additional penalties:
- For motorcycles: Suspension of driving license from 2 months to 4 months in case causing accident (Point c Clause 10 Article 6).
- For cars:
+ Suspension of driving license from 1 month to 3 months (Point b Clause 11 Article 5).
+ Suspension of driving license from 2 months to 4 months in case causing accident (Point c Clause 11 Article 5).
7. Failure to comply with road markings
Fines:
- For motorcycles: VND 100,000 - VND 200,000 (Point a Clause 1 Article 6).
- For cars: VND 200,000 - VND 400,000 (Point a Clause 1 Article 5).
8. Entering blocked roads or restricted areas; going against traffic direction of one-way roads or roads where “Cấm đi ngược chiều” (No entry) signs are erected
Fines:
- For motorcycles:
+ VND 1,000,000 - VND 2,000,000 (Clause 5 Article 6).
+ VND 4,000,000 - VND 5,000,000 if causing accident (Point b Clause 7 Article 6).
- For cars:
+ VND 3,000,000 - VND 5,000,000 (Point c Clause 5 Article 5).
+ VND 10,000,000 - VND 12,000,000 if causing accident (Point a Clause 7 Article 5).
+ VND 16,000,000 - VND 18,000,000 if going against the traffic direction on a freeway, backing up on a freeway (Point a Clause 8 Article 5).
Additional penalties:
- For motorcycles:
+ Suspension of driving license from 1 month to 3 months (Point b Clause 10 Article 6).
+ Suspension of driving license from 2 months to 4 months in case causing accident (Point c Clause 10 Article 6).
- For cars:
+ Suspension of driving license from 2 months to 4 months (including the case of causing accident) (Point c Clause 11 Article 5).
+ Suspension of driving license from 5 months to 7 months in cases of going against the traffic direction on a freeway, backing up on a freeway (Point dd Clause 11 Article 5).
9. Entering roads erected with signs prohibiting entry of operated vehicles
Fines:
- For motorcycles: VND 400,000 - VND 600,000 (Point i Clause 3 Article 6).
- For cars: VND 1.000,000 - VND 2,000,000 (Point b Clause 4 Article 5).
Additional penalties:
- For motorcycles: Suspension of driving license from 1 month to 3 months (Point b Clause 10 Article 6).
- For cars: Suspension of driving license from 1 month to 3 months (Point b Clause 11 Article 5).
10. Operating a car without mirrors
Fines: VND 300,000 - VND 400,000 (Point a Clause 2 Article 16).
11. Operating the vehicle without a mirror on the left, or without a functional one
Fines: VND 100,000 - VND 200,000 (Point a Clause 1 Article 17).
12. The operator or the passenger on the vehicle does not wear a motorcycle helmet or does not wear it properly
Fines:
- For motorcycles: VND 200,000 - VND 300,000 (Point i Clause 2 Article 6).
- For cars: not applicable for cars.
13. Failure to have a driving license (people who are old enough to drive a vehicle)
Fines:
- For motorcycles:
+ VND 800,000 - VND 1,200,000 for operating motorcycle whose engine displacement is under 175 cm3 (Point a Clause 5 Article 21).
+ VND 3,000,000 - VND 4,000,000 for operating motorcycle whose engine displacement is above 175 cm3 (Point b Clause 7 Article 21).
- For cars: VND 4,000,000 - VND 6,000,000 (Point b Clause 8 Article 21).
14. Operating a vehicle without certificate of vehicle registration
Fines:
- For motorcycles: VND 300,000 - VND 400,000 (Point a Clause 2 Article 17).
- For cars: VND 2,000,000 - VND 3,000,000 (Point a Clause 4 Article 16).
15. Failure to have or carry an unexpired Certificate of civil liability insurance for motor vehicles
Fines:
- For motorcycles: VND 100,000 - VND 200,000 (Point a Clause 2 Article 21).
- For cars: VND 400,000 - VND 600,000 (Point b Clause 4 Article 21).
16. Having blood or breath alcohol concentration when operating vehicle
Fines and additional penalties:
- For motorcycles:
+ VND 2,000,000 - VND 3,000,000 for operating a vehicle under the influence of alcohol but BAC does not exceed 50 mg per 100 ml of blood or BrAC does not exceed 0.25 mg per liter of breath (Point c Clause 6 Article 6). Additional penalties: Suspension of driving license from 10 months to 12 months (Point dd Clause 10 Article 6).
+ VND 4,000,000 - VND 5,000,000 for operating the vehicle while BAC exceeds 50 - 80 mg per 100 ml of blood, or BrAC exceeds 0.25 - 0.4 mg per liter of breath (Point c Clause 7 Article 6). Additional penalties: Suspension of driving license from 16 months to 18 months (Point e Clause 10 Article 6).
+ VND 6,000,000 - VND 8,000,000 for operating the vehicle while BAC exceeds 80 mg per 100 ml of blood or BrAC exceeds 0.4 mg per liter of breath (Point e Clause 8 Article 6). Additional penalties: Suspension of driving license from 22 months to 24 months (Point g Clause 10 Article 6).
- For cars:
+ VND 6,000,000 - VND 8,000,000 for operating a vehicle under the influence of alcohol but BAC does not exceed 50 mg per 100 ml of blood or BrAC does not exceed 0.25 mg per liter of breath (Point c Clause 6 Article 5). Additional penalties: Suspension of driving license from 10 months to 12 months (Point e Clause 11 Article 5).
+ VND 16,000,000 - VND 18,000,000 for operating the vehicle while BAC exceeds 50 - 80 mg per 100 ml of blood, or BrAC exceeds 0.25 - 0.4 mg per liter of breath (Point c Clause 8 Article 5). Additional penalties: Suspension of driving license from 16 months to 18 months (Point g Clause 11 Article 5).
+ VND 30,000,000 - VND 40,000,000 for operating the vehicle while BAC exceeds 80 mg per 100 ml of blood, or BrAC exceeds 0.4 mg per liter of breath (Point a Clause 10 Article 5). Additional penalties: Suspension of driving license from 22 months to 24 months (Point h Clause 11 Article 5).
17. Exceeding the speed limits
Fines and additional penalties:
- For motorcycles:
+ VND 200,000 - VND 300,000 for exceeding the speed limits by from 5 km/h to under 10 km/h (Point c Clause 2 Article 6).
+ VND 600,000 - VND 1,000,000 for exceeding the speed limits by from 10 km/h to under 20 km/h (Point a Clause 4 Article 6).
+ VND 4,000,000 - VND 5,000,000 for exceeding the speed limits by more than 20 km/h (Point a Clause 7 Article 6). Additional penalties: Suspension of driving license from 2 months to 4 months (Point c Clause 10 Article 6).
- For cars:
+ VND 800,000 - VND 1,000,000 for exceeding the speed limits by from 5 km/h to under 10 km/h (Point a Clause 3 Article 5).
+ VND 3,000,000 - VND 5,000,000 for exceeding the speed limits by from 10 km/h to under 20 km/h (Point i Clause 5 Article 5). Additional penalties: Suspension of driving license from 1 month to 3 months (Point b Clause 11 Article 5).
+ VND 10,000,000 - VND 12,000,000 for exceeding the speed limits by more than 35 km/h (Point c Clause 7 Article 5). Additional penalties: Suspension of driving license from 2 months to 4 months (Point c Clause 11 Article 5).
The above are some common traffic violations on Tet holiday 2021, in which the act of speeding and driving a vehicle with a blood or breath alcohol concentration are the most common violations on these days. Decree No. 100/2019/NĐ-CP of Vietnam’s Government has specified heavy fines for these violations. Therefore, individuals when participating in traffic during the upcoming New Year and Lunar New Year 2021 should pay attention to avoid fines.
