According to Decree 112/2021/ND-CP , Vietnamese enterprises operating in the service of sending Vietnamese workers to work abroad under contracts must make a deposit of 2 billion VND at a bank or bank branch. foreign goods legally established and operating in Vietnam.

Currently , in Article 10 of Decree 38/2020/ND-CP stipulating that enterprises operating in the service of sending Vietnamese workers to work abroad under contracts must deposit 1 billion VND at commercial banks. licensed to operate in Vietnam.

From January 1 , 2022, this margin level will be increased, specifically:

- The enterprise makes a deposit of 2 billion VND at a bank or foreign bank branch legally established and operating in Vietnam (hereinafter referred to as the deposit receiving bank).

- In case a service enterprise assigns a branch to perform service activities of sending Vietnamese workers to work abroad under a contract, an additional deposit of VND 500,000,000 must be made for each assigned branch. service.

Thus, compared with the current, the margin level for enterprises operating in the service of sending Vietnamese workers to work abroad under contracts has increased from 1 billion VND to 2 billion VND.

In addition, for Vietnamese enterprises that send Vietnamese workers to train and improve professional qualifications and skills abroad, they must make a deposit at an established bank or foreign bank branch. and operate legally in Vietnam.

The deposit is equal to 10% of an economy class airfare from the workplace to Vietnam, calculated according to the number of employees going to work abroad in the contract of receiving interns.

Regarding the deposit ceiling for employees, Decree 112/2021 stipulates that service enterprises and employees can agree on the bank to receive the deposit and the deposit, in which the deposit must not exceed the prescribed ceiling. and must clearly state in the contract of sending Vietnamese workers to work abroad. As follows:

- For the Taiwan market (China), all industries and occupations except seafarers of offshore fishing vessels and transport ships, the ceiling of deposit for employees is 12 million dong; for the Korean market is 36 million dong.

- Other countries and regions (except Japan, countries in the Americas, Southeast Asia, the Middle East are not escrow) ), all industries and occupations except seafarers of offshore fishing vessels and ships For transportation, the ceiling deposit for employees is equivalent to the value of 01 economy class airfare from the workplace to Vietnam.

Decree 112/2021/ND-CP takes effect from January 1, 2022.
