The Government issued Decision 721/QD-TTg dated 16/6/2022 approving the plan to simplify the regulation of business activities in Vietnam under the management function of the Ministry of Natural Resources and Environment.
Simplification of central administrative procedures in the field of land (Illustration)
Specifically, Decision 721/QD-TTg stipulates the plan to simplify central administrative procedures in the land sector in Vietnam as follows:
1. Administrative procedures at the central level of the service business for building land databases in Vietnam
Administrative procedures 1: Appraisal and assessment of conditions and capacity of organizations developing land database (administrative procedure code: 1.002972)
(1) The content of reducing and simplifying administrative procedures in Vietnam is as follows:
- Method of implementation: Abolition of central administrative procedures for service business lines to build land database.
Reasons for repeal:
+ This procedure is currently regulated in Clause 4, Clause 5, Article 5b of Decree 43/2014/ND-CP dated May 15, 2014 of the Government detailing the implementation of a number of articles of the Land Law and amended in Clause 2, Article 1 of Decree 136/2018/ND-CP dated October 5, 2018 of the Government amending a number of articles of the decrees relating to business investment conditions in the field of natural resources and environment in Vietnam.
+ Regarding the appraisal and evaluation of eligibility and capacity to build a national land database, in the period from 2018 to now, no dossiers have arisen for these administrative procedures.
According to this Decree, it is necessary to abolish this administrative procedure to ensure uniformity, reduce administrative procedures and implementation costs for organizations building land database in Vietnam.
(2) Recommendations for implementation of the simplified scheme are as follows:
- Abolish Clause 4 and Clause 5 Article 5b of Decree 43/2014/ND-CP dated May 15, 2014 of the Government (supplemented as prescribed in Clause 6 Article 2 of Decree 01/2017/ND-CP dated January 6, 2017 of the Government amending and supplementing a number of decrees detailing the implementation of the Land Law).
- Implementation roadmap: Period 2022-2025.
2. Central administrative procedures for land price determination services in Vietnam
Administrative procedures 2: grant, renewal and re-grant of land valuation certificates (administrative procedure code: 1,000732)
(1) The content of reduction and simplification of administrative procedures is as follows:
- Regarding the implementation method: Supplement on how to submit documents and receive the results of administrative procedure settlement under the online public service in Vietnam.
Reason: In accordance with Decree 61/2018/ND-CP and create conditions for individuals to choose the form of submission and receipt of results.
- Regarding the composition of the dossier:
+ Remove the completed certificate on fostering land valuation in Vietnam.
Reason: This component of the application, the certificate authority already has, therefore, only needs to amend in the Certificate Application Form in the direction of supplementing the information already in the course.
+ Abolish the identity card or citizen's identity card or passport (hereinafter referred to as identification document) of the applicant for land valuation certificate in Vietnam.
Reason: This dossier component is already included in the population management data, so the certificate authority will exploit on the basis of the national population data for personal information requesting the certificate.
- Regarding the form of filing the dossier components: Additional regulations on the form of filing on the electronic environment in the direction of e-certification copy for dossier components in Vietnam.
(2) Recommendations for implementation of the simplified scheme are as follows:
- Abolish Article 4, Point b, Point d, Clause 1, Article 5, Point b, Clause 2, Article 6; amend Point dd, Clause 1, Last Paragraph, Clause 2, Clause 3, Article 5 of Circular 61/2015/TT-BTNMT to comply with the provisions of the law on investment, at the same time this condition has been stipulated in Decree 44/2014/ND-CP as amended and supplemented in Decree 01/2017/ND-CP and Decree 136/2018/ND-CP.
- Implementation roadmap: Period 2022-2025.
