This is an important provision stipulated in Circular 16/2014/TT-BTNMT on the Operational Regulations of the Mineral Exploitation Rights Auction Council issued by the Minister of Natural Resources and Environment on April 14, 2014.

According to Article 4 of Circular 16/2014/TT-BTNMT, the principles of operation of the Council for Mineral Extraction Rights Auction are as follows:
The Council operates in the form of a conference and collective voting.
Council members work concurrently according to policies.
Council members participate in discussions and vote on issues within the tasks of the Council. In case of a tie vote, the final decision belongs to the side with the Chairman of the Council. When necessary, the Chairman of the Council will send a written report to the Ministry of Natural Resources and Environment, the Provincial People's Committee for consideration and decision on issues with diverse opinions, according to their authority.
Council meetings are considered valid when at least 2/3 of the official members of the Council participate, and the meeting is presided over by the Chairman of the Council (or the authorized Vice Chairman).
Before the Council meeting, an invitation must be sent along with related documents to the Council members at least 03 days in advance.
If a Council member is absent from one auction session without a replacement but provides written comments on the meeting contents and is approved by the Chairman, it is considered valid.
If a Council member is absent from two Council meetings in one auction session without a written authorized replacement, the Chairman will report to the competent state authority; the absent member will not be allowed to attend subsequent auction sessions.
Council members and the standing agency of the Council are not permitted to provide Council information to organizations or individuals without the Chairman's consent.
