Which administrative issues can be reported and petitioned to the Ministry of Transport of Vietnam?

This is an important provision stipulated in Circular 50/2011/TT-BGTVT guiding the reception and handling of feedback and suggestions regarding administrative regulations within the management scope of the Ministry of Transport, issued by the Ministry of Transport of Vietnam on September 30, 2011.

Which administrative issues can be reported and petitioned to the Ministry of Transport of Vietnam? (Internet image)

As per Circular 50/2011/TT-BGTVT, the reflection and recommendation of organizations and individuals regarding administrative regulations under the management scope of the Ministry of Transport of Vietnam are specified as follows:

1. Organizations and individuals can reflect and recommend the following issues:

- Specific obstacles in implementing administrative regulations due to delays, complications, non-compliance, or improper implementation by agencies and units under the Ministry; by officials of agencies and units under the Ministry.

- Administrative regulations on transport that are not suitable for the practical situation.

- The inconsistency and lack of uniformity in administrative regulations on transport.

- Illegal administrative regulations on transport.

- Administrative regulations on transport that are contrary to international treaties to which Vietnam is a signatory or member.

- Other issues related to administrative regulations on transport.

- The handling plan for reflections and recommendations specified in Clauses 1, 2, 3, 4, 5, and 6 of this Article.

- Initiatives for issuing new administrative regulations on transport related to business activities and the lives of the people.

2. Forms of reflection and recommendations

Forms of reflection and recommendations include:

- Written reflection and recommendations;

- Telephone reflections and recommendations;

- Reflection and recommendations through feedback forms;

- Direct reflection and recommendations.

3. Requirements for reflection and recommendations

Requirements for written reflection and recommendations

+ Individuals and organizations reflect and recommend in writing to the following addresses:

- Directly at the Administration Office, Ministry of Transport of Vietnam, 80 Tran Hung Dao Street, Hanoi; or- By postal service to the Ministry of Transport, 80 Tran Hung Dao Street, Hanoi; or- Through the internet to the "Feedback" section on the Ministry of Transport's website (http://www.mt.gov.vn) to the receiving agency, "Administrative Procedures Control Office" of the Ministry of Transport’s Office (referred to as Administrative Procedures Control Office); or via email to: phananhkiennghi.tthc@mt.gov.vn

+ Use Vietnamese language, with the Vietnamese character set Unicode TCVN 6909: 2001.

+ Clearly state the content of the reflection or recommendation.

+ Clearly state the name, address, and phone number (or mailing address for contact) of the individual or organization reflecting or recommending.

Requirements for telephone reflections and recommendations

+ Individuals and organizations reflect and recommend by phone to the hotline number 04.39411797 of the Administrative Procedures Control Office.

+ Use Vietnamese language.

+ Clearly present the content of the reflection or recommendation.

+ Provide the name, address, and phone number (or mailing address for contact) of the individual or organization reflecting or recommending.

Requirements for reflection and recommendations through feedback forms

This form is only applied when agencies and units under the Ministry of Transport of Vietnam want to collect opinions from individuals or organizations on specific administrative regulations. Sending the feedback form can be done through one or multiple methods such as:

+ Sending official letters to collect opinions;

+ Collecting opinions through mass media;

+ Sending data messages via electronic networks (email, "Feedback" section on the Ministry of Transport’s website).

More details can be found in Circular 65/2011/TT-BCA, which comes into effect in Vietnam from November 18, 2011.
