What conditions must be met when renting to transport dangerous goods?

Recently, Circular 52/2013/TT-BTNMT was unanimously promulgated by the Minister of Natural Resources and Environment, regulating the transportation of dangerous goods consisting of hazardous substances and infectious substances.

Article 11 of Circular 52/2013/TT-BTNMT stipulates that in the case where the owner of hazardous goods hires the owner of the transport means to carry out the transportation of hazardous goods, they must comply with the following regulations:

First, for motor vehicles on road traffic:

- The owner of hazardous goods must have an economic contract or a written agreement regarding the transportation with the owner of the transport means for hazardous goods who has a transportation license suitable for the type of goods to be transported;- In the event that the owner of the transport means for hazardous goods does not have a suitable transportation license for the type of goods to be transported, the owner of hazardous goods must fully meet the transportation conditions stipulated in Articles 5, 6, 7, and 10 of Circular 52 and submit a dossier requesting the issuance of a transportation license for hazardous goods for each shipment in accordance with Articles 13 and 14 of this Circular.

Second, for inland waterway and railway vehicles: The owner of hazardous goods must have an economic contract or a written agreement regarding the transportation with the owner of the transport means for hazardous goods, which includes a clause stipulating that the owner of the transport means for hazardous goods must meet the conditions for safe transportation and environmental protection suitable for the type of goods to be transported in accordance with Articles 8 and 9 of Circular 52.

Note: Hiring the transportation of hazardous goods must comply with the provisions of the Civil Code.
