Vietnam’s new regulations on coordination in providing information during the inspection of the People's Public Security force

According to Circular No. 03/2015/TT-BCA of the Ministry of Public Security of Vietnam, when coordinating in administrative inspection activities of the People's Public Security force, the person making the inspection decision, head of the inspection team, members of the inspection team, agencies, organizations, relevant individuals shall request to provide information and documents related to inspection content as prescribed in Article 35 of Decree No. 86/2011/NĐ-CP of Vietnam’s Government.

When deemed necessary, the person making the decision to inspect, the head of the inspection team and members of the inspection team directly or in writing request agencies, organizations, and individuals with information and documents related to the inspection content to provide such information and documents. Requests for providing information and documents must clearly define the content, time limit and form of providing information and documents.

Agencies, organizations and individuals are responsible for providing timely, on-time and complete information and are responsible before the law for the truthfulness and accuracy of the information and documents they provide. In case the request to provide information and documents cannot be fulfilled, there must be a document sent to the requester clearly stating the reason for not complying with the request to provide information and documents.

Moreover, during the inspection process, if there is a content or issue for which the Inspection Team does not have enough basis to conclude or handle, it deems it necessary to solicit expertise, the head of the inspection team recommends that the person making the inspection decision request the competent authority in the People's Police to make professional conclusions to serve the inspection work.
