Vietnam: Coordination in handling overlaps in administrative inspection activities of the People's Public Security

Recently, the Minister of Public Security of Vietnam issued Circular No. 03/2015/TT-BCA on coordination in administrative inspection activities of the People's Public Security force.

Currently, coordination in administrative inspection activities of the People's Public Security force aims to mobilize the necessary forces of functional units to organize and effectively carry out the administrative inspection work of the People's Public Security force.

According to Article 7 of Circular No. 03/2015/TT-BCA of the Ministry of Public Security of Vietnam, when there is an overlap in the scope, subjects, content, time, and inspection area of any unit or locality, the head of the inspection agency of that unit or locality will handle it; in case of exceeding authority, promptly report and propose to the head of the superior inspection agency for handling.

When receiving an inspection decision from an agency other than the People's Public Security force for an agency or unit under its management, heads of police agencies and units that are subject to inspection are responsible for reporting to superior police inspection agencies to handle overlaps in scope, subjects, content, time, and area of inspection according to authority.

Besides, this Circular strictly regulates the principles when coordinating in administrative inspection activities of the People's Public Security force:

- Comply with the provisions of this Circular and relevant laws; in accordance with assigned functions, tasks and powers; do not obstruct the normal operations of coordinating agencies and units.

- Ensure timeliness, accuracy, efficiency, objectivity and democracy in the process of coordinating and performing inspection tasks.

- Difficulties and obstacles in the coordination process must be promptly resolved by participating agencies, units and individuals. In case there are difficulties or problems that cannot be resolved by the coordinating agencies and units, the head of the inspection agency shall report to the head of the police agency at the same level for decision.

- It is strictly prohibited to take advantage of coordination to illegally interfere with administrative inspection activities and the performance of functions and tasks of agencies and units participating in coordination.
