Regarding this matter, LawNet would like to answer as follows:

On April 12, 2024, the Prime Minister of Vietnam  issued Decision 304/QD-TTg on the implementation plan for the Law on the Management and Protection of National Defense Works and Military Zones 2023.

The implementation plan for the Law on the Management and Protection of National Defense Works and Military Zones 2023 is as follows:

(1) Comprehensive organization,  dissemination, popularization, and training on the content of the Law

- Compilation of materials for dissemination and popularization of the content of the Law on the Management and Protection of National Defense Works and Military Zones 2023 and the guiding documents for the implementation of the Law.

+ Leading agency: Ministry of Defense.

+ Coordinating agencies: relevant ministries and departments.

+ Implementation period: 2024 and the following years.

- Organizing conferences to disseminate the Law and the detailed regulations of certain provisions of the Law to central agencies and People's Committees of provinces and centrally-run cities.

+ Leading agency: Ministry of Defense.

+ Coordinating agencies: Ministries, inter-ministerial agencies, government agencies, People's Committees of provinces, and centrally-run cities.

+ Forms: Direct and online.

+ Implementation period: Quarter 1 and Quarter 2 of 2025.

- Organizing conferences to grasp thoroughly and disseminate the Law and the documents detailing certain provisions of the Law at the local level.

+ Leading agency: People's Committees of provinces and centrally-run cities.

+ Coordinating agencies: State administrative agencies, public sector organizations, local authorities, state-owned enterprises in provinces and centrally-run cities.

+ Forms: Direct and online.

+ Implementation period: Quarter 2 and Quarter 3 of 2025.

- Disseminating the Law and the documents detailing certain provisions of the Law through diverse and appropriate forms on mass media.

+ Implementing agency: Ministry of Information and Communications, guiding Vietnam Television, Voice of Vietnam, Vietnam News Agency, and other mass media in central and local levels.

+ Coordinating agencies: Ministry of Defense, People's Committees of provinces and centrally-run cities.

+ Implementation period: Regularly.

- Organizing in-depth training on the Law and the documents detailing certain provisions of the Law.

+ Ministry of Defense, in coordination with relevant ministries, departments, and local authorities, organizes in-depth training on the Law and the documents detailing certain provisions of the Law for officials, and individuals directly involved in the management and protection of national defense works and military zones of ministries, departments, and local authorities.

+ Implementation period: 2025 and subsequent years.

(2) Reviewing existing legislative documents related to the management and protection of national defense works and military zones; proposing amendments, replacements, or annulments of provisions that are no longer suitable, effective, or issuing new legislative documents to ensure uniformity and consistency with the Law.

- At the central level

+ Leading agencies: Ministries, inter-ministerial agencies review the legislative documents issued by themselves or submitted to the competent authority, send the results to the Ministry of Defense for synthesis, and report to the Prime Minister.

+ Completion time: August 2024.

- At the local level

+ Leading agencies: People's Committees of provinces and centrally-run cities review the legal documents issued by People's Councils, People's Committees at the provincial level, send the review results to the Ministry of Defense for synthesis, and report to the Prime Minister.

+ Completion time: August 2024.

(3) Developing documents detailing measures for the implementation of the Law

- Developing decrees regulating the classification, grouping, and determination of the scope of protection for national defense works and military zones.

+ Leading agency: Ministry of Defense.

+ Coordinating agencies: Ministry of Justice, relevant ministries, and inter-ministerial agencies.

+ Submission time to the Government: Before October 15, 2024.

- Developing decrees detailing certain provisions of the Law on the Management and Protection of National Defense Works and Military Zones.

+ Leading agency: Ministry of Defense.

+ Coordinating agencies: Ministry of Justice, relevant ministries, and inter-ministerial agencies.

+ Submission time to the Government: Before October 15, 2024.

- Developing Prime Minister's decisions on the management and protection of national defense works and military zones belonging to the Special Group as regulated by the Law.

+ Leading agency: Ministry of Defense.

+ Coordinating agencies: Ministry of Justice, relevant ministries, departments, and local authorities.

+ Submission time to the Prime Minister: before October 15, 2024.

- Developing Ministry of Defense's circulars detailing the implementation of certain provisions of the Law on the Management and Protection of National Defense Works and Military Zones.

+ Leading agency: Ministry of Defense.

+ Coordinating agencies: relevant ministries, departments, and agencies.

+ Issuance time: Before November 15, 2024.

(4) Organizing monitoring, inspection and reporting on the results of Law implementation

+ Leading agency:  Ministry of National Defense.

+ Coordinating agencies: Ministries, ministerial-level agencies, Government agencies, People's Committees of provinces and centrally run cities.

+ Implementation period: Periodically and upon request.
