Vietnam: Duties of ministerial inspectorate

Recently, the Government Inspectorate issued Circular No. 08/2011/TT-TTCP prescribing standards of ministerial inspectorates and ministerial-level agencies of Vietnam.

According to Article 2 of Circular No. 08/2011/TT-TTCP, duties of ministerial inspectorates and ministerial-level agencies are specified as follows:

1. Ministerial inspectorates are responsible to the Minister, to the Government Inspector General and the law in performing the state management function of inspection, resolving complaints and denunciations, preventing and fighting corruption within the scope of state management of the Ministry. To be specific:

- Develop Inspection Programs and Plans and submit them to the Minister for decision and organize the implementation of those Programs and Plans;

- Develop and submit to the Minister for consideration for promulgation or submit to competent authorities for promulgation of legal documents; propose amendments to legal documents and policies in inspection work, settlement of complaints and denunciations, and prevention and combat of corruption under the Ministry's management;

- Organize specialized inspection professional guidance for agencies assigned to perform specialized inspection functions under the Ministry and Department Inspectorate; guide, urge and inspect units under the Ministry to implement legal regulations on inspection, settlement of complaints and denunciations and prevention and combat of corruption;

- Organize the work of synthesizing information, statistics, and reporting on activities of the Inspection sector within the scope of state management of the Ministry;

- Organize and direct the preliminary and final reviews and lessons learned from inspection activities, resolve complaints and denunciations and prevent and combat corruption within the scope of state management of the Ministry, and on that basis, propose, supplement, amend and complete legal documents promulgated by competent authorities; host or participate in scientific topics, scientific applications in state management of inspection, settlement of complaints and denunciations and prevention and combat of corruption.

2. Lead and direct inspection of the implementation of policies, laws and tasks and powers of agencies, organizations and individuals under the direct management of the Ministry; inspection of state-owned enterprises established by the Minister's decision; inspection of the observance of specialized laws, professional and technical regulations, industry and field management rules by agencies, organizations and individuals and inspection of other cases assigned by the Minister within the scope of management according to the sectors and fields that the Ministry is in charge of.

3. Advise and assist the Minister in organizing and directing the implementation of the tasks of resolving complaints and denunciations and preventing and combating corruption according to the provisions of law.

4. Perform tasks as prescribed in Article 19 of the Law on Inspection of Vietnam and guiding documents.

5. Manage officials and inspectors under the Ministerial Inspectorate; manage and use assigned assets and finances effectively according to regulations.

6. Perform other tasks assigned by the Minister or the Government Inspector General according to the provisions of law.
