Vietnam: 04 responsibilities of authorities conducting inspection of the implementation of policies, strategies, planning, and plans

On September 15, 2006, the Government of Vietnam issued Decree 99/2006/ND-CP on the inspection work for the implementation of policies, strategies, planning, and plans.

Article 14 of Decree 99/2006/ND-CP stipulates the responsibilities of the authorities conducting inspection of the implementation of policies, strategies, planning, and plans in Vietnam as follows:

  1. Notify the inspected agency of the time and content of the inspection, send the inspection conclusion to the inspected agency; report the inspection results to the competent authority and propose handling measures;
  2. Reward under authority or promptly recommend the competent authority to reward agencies, organizations, and individuals that well-implement policies, strategies, planning, and plans;
  3. Handle under authority or promptly recommend the competent authority to handle agencies, organizations, and individuals that fail to implement or poorly implement policies, strategies, planning, and plans;
  4. In case of detecting policies, strategies, planning, and plans that are inappropriate, unfeasible, or erroneous, handle under the authority or promptly recommend the competent state authority to review and handle.

Concurrently, the responsibilities of the inspected entity in Vietnam are clearly defined as follows:

- Coordinate and facilitate the inspection authority during the inspection process;

- Comply strictly with the policies, information, and reporting requirements of the inspection authority;

- Report and provide truthful information and documentation; take legal responsibility for the content of the reports, information, and documents provided;

- Comply with the decisions of the inspection authority;

- Propose and explain the conclusions of the inspection authority or the competent person;

- Be responsible for the non-implementation or incorrect implementation of policies, strategies, planning, and plans.
