Using Fake Health Checkup Certificates Can Result in Up to 5 Years of Imprisonment

Currently, an alarming situation regarding the sale of counterfeit health check certificates is occurring openly and rampantly. Buyers, out of reluctance to spend time undergoing a health examination, have intentionally abetted those who produce and sell counterfeit health check certificates. Maximum 7-year imprisonment for the crime of forging seals and documents of agencies, organizations

The act of forging or using fake health certificates may be prosecuted with the crime "Forgery of seals and documents of agencies, organizations" regulated in Article 267 of the 1999 Penal Code.

Regarding subjects and purposes, as stipulated in Clause 1, Article 267, the subject of the crime of forging seals and documents of agencies and organizations includes not only the person directly forging but also the person using those seals and documents to deceive agencies, organizations, or citizens.

Regarding penalties, the administrative fine ranges from VND five million to VND fifty million or imprisonment from six months to three years for the crime of forging seals and documents of agencies, organizations. Additionally, the penalty can be increased to two to five years imprisonment if the crime involves one of the following circumstances: "organized crime, repeated offenses, causing serious consequences, or dangerous recidivism."

Article 267. Forgery of seals and documents of agencies, organizations

  1. Anyone who forges seals, documents, or other papers of agencies, organizations, or uses those seals, documents, or papers to deceive agencies, organizations, or citizens, shall be fined from VND five million to VND fifty million or imprisoned from six months to three years.

  2. Committing the offense in one of the following circumstances shall be subject to imprisonment from two years to five years:

a) Organized crime;

b) Repeated offenses;

c) Causing serious consequences;

d) Dangerous recidivism.

  1. Committing the offense causing very serious or particularly serious consequences shall be subject to imprisonment from four years to seven years.

  2. The offender may also be fined from VND five million to VND fifty million.
