Regulations on the use of land for road safely corridor in Vietnam from 2025 (Internet image) 

On June 27, 2024, the National Assembly of Vietnam officially passed the Law on Road 2024, with many new regulations related to road traffic.

Regulations on the use of land for road safely corridor in Vietnam from 2025

According to Article 16 of the Law on Road 2024 on the management and use of land for road safely corridor in Vietnam:

- land for road safely corridor that has been reclaimed by the State must be managed and used according to the provisions of the Law on Road 2024, the land law, public asset management and use laws, and other related legal provisions.

- (*) The use of land for road safely corridor must ensure the following:

+ Ensure the safety of road structures and other structures within the road safety corridor;

+ Do not block road signs, do not affect the visibility of vehicles, ensure road traffic order and safety;

+ Protect the landscape and environment according to legal regulations.

- land for road safely corridor that has not been reclaimed by the State can continue to be used according to the Land Law 2024 and meet the requirements under clause (*).

- Planting, nurturing, and harvesting trees within the road safety corridor must comply with clause (*) and the following provisions:

+ Take necessary measures to avoid the risk of trees breaking and falling, causing danger to road users and damage to road structures and adjacent structures;

+ Prune trees that block road signs, obscure the view of drivers, and affect road traffic safety;

+ Ensure that tree activities do not impair road quality and maintenance.

- The use of land for road safely corridor overlapping with the protection scope of dikes, adjacent areas of irrigation works, irrigation protection scope, and the railway protection corridor must comply with the Dike Law 2006, Irrigation Law 2017, Railway Law 2017, Land Law 2024, Law on Road 2024, and other related legal provisions.

- Service roads must be built outside the road safety corridor, except when the service road is also a side road.

If it is not possible to arrange the service road outside the road safety corridor, it can be placed within the road safety corridor, but it must meet the following conditions:

+ The remaining width of the road safety corridor is sufficient to expand the road according to the planning;

+ Ensure the safety of road structures;

+ Ensure road traffic safety and vehicle visibility.

Regulations on land funds reserved for road infrastructure facilities in Vietnam

- The land funds reserved for road infrastructure facilities must be consistent with the road network planning; provincial land use planning and plan; district land use planning and other related planning.

- The land funds reserved for road infrastructure facilities in urban areas is part of the land designated for transportation compared to urban construction land.

- The proportion of land allocated for transportation out of the urban construction land ranges from 11% to 26%, in accordance with the standards of infrastructure development and the landscape architecture of urban inner areas as prescribed by urban planning laws and related legal provisions.

- The percentage of land allocated for transportation compared to urban construction land should be at least 50% of the percentage as stipulated in clause 3 of Article 12 of the Law on Road 2024 for urban areas with specific characteristics as defined by the Standing Committee of the National Assembly.
