There will be 02 Decrees guiding the Law on the Management and Protection of National Defense Works and Military Areas in Vietnam (Internet image) 

Regarding this matter, LawNet would like to answer as follows:

The below content is mentioned in Decision 304/QD-TTg dated April 12, 2024, on the implementation plan for the enforcement of the Law on the Management and Protection of National Defense Works and Military Areas, issued by the Prime Minister.

There will be 02 Decrees guiding the Law on the Management and Protection of National Defense Works and Military Areas in Vietnam

There will be 02 Decrees guiding the Law on the Management and Protection of National Defense Works and Military Areas issued before October 15, 2024, including:

(1) Decree guiding the classification, grouping, and determination of the scope of protection for national defense works and military areas 

- Leading agency: Ministry of Defense.

- Coordinating agencies: Ministry of Justice, relevant ministries, and agencies.

(2) Decree detailing certain provisions of the Law on the Management and Protection of National Defense Works and Military Areas.

- Leading agency: Ministry of Defense.

- Coordinating agencies: Ministry of Justice, relevant ministries, and agencies.

In addition to the aforementioned 02 Decrees, the formation of 02 legislative documents regulating certain provisions related to the Law on the Management and Protection of National Defense Works and Military Areas will also be carried out, specifically:

(i) Forming Decisions of the Prime Minister on the management and protection of national defense works and military areas belonging to the Special Group as stipulated in the Law on the Management and Protection of National Defense Works and Military Areas.

- Leading agency: Ministry of Defense.

- Coordinating agencies: Ministry of Justice, relevant ministries, and local authorities.

- Deadline for submission to the Prime Minister: October 15, 2024.

(ii) Forming Circular of the Ministry of Defense detailing the implementation of certain provisions of the Law on the Management and Protection of National Defense Works and Military Areas.

- Leading agency: Ministry of Defense.

- Coordinating agencies: Relevant ministries and agencies.

- Deadline for issuance: Before November 15, 2024.

Note that the implementation of the above contents must ensure the following purposes and requirements:

** Purposes:

- Specific determination of work content, deadlines, completion progress, and responsibilities of relevant agencies and organizations in the implementation of the Law on the Management and Protection of National Defense Works and Military Areas, ensuring timeliness, consistency, uniformity, and effectiveness.

- Determination of responsibilities and coordination mechanisms between ministries, inter-ministerial agencies, government agencies, and local authorities in conducting activities to implement the Law on the Management and Protection of National Defense Works and Military Areas nationwide.

- Raising awareness of the Law on the Management and Protection of National Defense Works and Military Areas and the responsibilities of different levels, sectors, provinces, centrally-run cities, and people in implementing the Law on the Management and Protection of National Defense Works and Military Areas.

** Requirements:

- Ensuring unified direction from the government and the Prime Minister; close, regular, and effective coordination between ministries, ministerial agencies, government agencies, People's Committees of provinces, centrally-run cities, and relevant agencies and organizations in the implementation of the Law on the Management and Protection of National Defense Works and Military Areas.

- The work content must be associated with the responsibilities and roles of the agencies assigned as leads in coordination with ministries, ministerial agencies, government agencies, and relevant agencies and organizations in the implementation of the Law on the Management and Protection of National Defense Works and Military Areas.

- Determining specific timelines to ensure that, from January 1, 2025, the Law and detailed guiding documents for the implementation of the Law on the Management and Protection of National Defense Works and Military Areas are uniformly and synchronously implemented nationwide.

- Regularly inspecting, urging, guiding, and promptly resolving difficulties and obstacles in the organization and implementation of the Law on the Management and Protection of National Defense Works and Military Areas.

The Law on the Management and Protection of National Defense Works and Military Areas will come into effect on January 1, 2025. This law regulates the management and protection of national defense works and military areas; rights, obligations, and responsibilities of agencies, units, organizations, households, and individuals; and regimes and policies in the management and protection of national defense works and military areas.
