Specific regulations on the implementation process of tasks of the National-Level Science and Technology Program in Vietnam (illustration)

Circular 05/2015/TT-BKHCN specifies in detail the implementation process of tasks of the National-Level Science and Technology Program (Science and Technology tasks of the Program) as follows:

1. Organizing the Signing of the Contract to Implement the Program's Tasks

- Based on the Decision approving the Program's tasks, the presiding Ministry organizes the signing of a contract to implement the tasks with the presiding organization;- The presiding organization is responsible for organizing the implementation of the tasks according to the objectives, content, progress, and efficient use of the allocated funds as stipulated in the contract.

2. Adjustments During the Task Implementation Process

- The presiding organization sends a written request to the presiding Ministry proposing and explaining the adjustments to the objectives, content, products, implementation time, and approved budget. Adjustments are carried out according to the regulations in Circular 04/2015/TT-BKHCN;- The presiding Ministry approves the adjustments after receiving the consensus from the Ministry of Science and Technology for matters requiring its prior consent before approval.

3. Inspection and Evaluation of the Program’s Task Implementation Process

- The presiding Ministry cooperates with the Ministry of Science and Technology to organize the inspection and evaluation of the task implementation according to the regulations in Circular 04/2015/TT-BKHCN;- The presiding organization is responsible for preparing and providing all information related to the tasks being implemented and facilitating the inspection and evaluation.

4. Termination of the Contract

- The contract is terminated under the circumstances stipulated in Article 5 of the Model Contract for Scientific Research and Technology Development issued with Circular No. 05/2014/TT-BKHCN;- The sequence and procedures for terminating the contract during the task implementation process are carried out according to the regulations in Circular 04/2015/TT-BKHCN;- Based on the termination decision, parties shall proceed with the contract liquidation procedures according to the terms of the signed contract and the provisions of the law.

5. Evaluation, Acceptance, Recognition of the Program’s Task Results

The presiding Ministry organizes the evaluation, acceptance, recognition, and public disclosure of the Program’s task results according to the regulations in Circular 11/2014/TT-BKHCN.

6. Contract Liquidation and Exploitation of the Program’s Task Results

- The presiding Ministry organizes the contract liquidation with the presiding organization as per the regulations;- The presiding organization is responsible for managing, exploiting, and transferring the Program's task results according to the provisions of the law. Intellectual property rights, rights to use the Program’s task results, are implemented in accordance with the law on science and technology and intellectual property;- The registration and storage of the Program’s task results are carried out in accordance with Circular 14/2014/TT-BKHCN.

7. Asset Handling

Asset handling after the completion of the Program's tasks is carried out in compliance with current regulations.
