Selling Groceries Alongside Herbicides

My uncle's house operates a grocery selling dried foods, confectioneries, various beverages, etc. Recently, I heard that he plans to add some types of pesticides and herbicides for sale because the neighbors around have asked to buy them frequently. I have noticed that these types of chemicals are hazardous, and if, by any chance, they are stored together with food products and unintentionally spilled, it could be very dangerous. Is it a violation to trade goods stored together in such a manner?

Regarding this issue, the Legal Secretary has the following comments:

Pesticides and herbicides are among the chemicals listed in the List of Plant Protection Products as stipulated in the 2013 Law on Plant Protection and Quarantine and Circular 03/2016/TT-BNNPTNT.

According to point a, Clause 1, Article 25 of Decree 31/2016/ND-CP, trading plant protection products together with other types of goods such as food, beverages will be subject to a fine ranging from 1,000,000 VND to 2,000,000 VND.

On the other hand, the State has very strict regulations regarding plant protection products, and the trading of these items must meet certain conditions as per Circular 21/2015/BNNPTNT and must be approved by the local authorities where the business is located.

Therefore, your uncle must carefully consider the issue of trading plant protection products to avoid legal violations.
