Segment of River for Assessing Wastewater Receiving Capacity and River Carrying Capacity

On December 29, 2017, the Ministry of Natural Resources and Environment promulgated Circular 76/2017/TT-BTNMT, which specifically stipulates the segmentation of rivers to assess their capacity to receive wastewater and the carrying capacity of rivers.

Circular 76 stipulates the segmentation of rivers to assess their capacity to receive wastewater and their load-bearing capacity, based on the following grounds:

- Confluence and bifurcation locations on the river;- The function of the water source, the purpose of river water usage; locations of water extraction, usage, and discharge facilities; locations of reservoirs, and water regulation structures on the river;- The maximum length of saltwater intrusion at a salinity of 4.0‰ for river segments affected by tides;- Requirements for the conservation and development of aquatic ecosystems, historical, cultural, tourism, and religious values related to the water source;- Especially for transnational and inter-provincial rivers, besides the aforementioned grounds, the national border and provincial administrative boundaries must also be taken into account.

Additionally, Circular 76 also stipulates the delineation of a river segment as follows:

- A river segment is defined by two (02) adjacent cross-sections with a length of 10km or more, except for river segments affected by tides and rivers flowing through urban areas, biodiversity conservation areas, and cultural value conservation areas.

In cases where a river segment is determined to be less than 10km in length, based on the degree of flow variation, water usage purposes, and water source protection requirements, it shall be integrated with the adjacent segment;

- For river segments affected by tides with a maximum saltwater intrusion length corresponding to a salinity of 4.0‰, they shall be segmented as one.- For rivers flowing through urban areas, biodiversity conservation areas, and cultural value conservation areas related to the water source, they shall be considered to be segmented as one.
