Responsibility for Developing Plans to Protect Irrigation Works of Organizations and Individuals

Law on Irrigation 2017 was promulgated on June 19, 2017. According to the provisions of this Law, organizations and individuals exploiting irrigation works have the responsibility to formulate plans to protect these irrigation works. So, what are the specific regulations on the plans to protect irrigation works?

According to the provisions of Article 41 of the 2017 Irrigation Law, the plan for protecting irrigation works includes the following main contents:

- Characteristics of the terrain, design parameters, layout map of the project and boundary markers delineating the protection scope of the irrigation works;- Management, operation, and protection status of the irrigation works;- Regular, periodic, and ad-hoc reporting and inspection regime;- Regulations on limiting or prohibiting large load-bearing vehicles from circulating within the protection scope of the works; fire prevention and fighting regulations; safety protection for areas storing documents, warehouses containing explosives, flammable substances, toxic substances;

- Organization of forces and assignment of responsibilities for protecting the works;- Organization of inspection and control of people and vehicles entering and exiting the works;- Prevention, detection, and prevention of acts infringing, destroying the works and adjacent areas;- Protection and handling of the works in case of incidents or risk of incidents.

The authority to approve the protection plan for irrigation works is stipulated as follows:

- The Minister of Agriculture and Rural Development approves the protection plan for irrigation works managed by the Ministry;- Provincial People's Committee approves or delegates to the district People's Committee the approval of protection plans for irrigation works within the locality, except for irrigation works specified in point a of this clause and clause 4 of this Article.

Organizations and individuals exploiting small-scale irrigation works decide on the protection plan for such irrigation works.
