Market management organizations in Vietnam

Article 8 of Decree No. 60/2024/ND-CP stipulates that market management organizations include:

- Market construction investors;

- Enterprises, cooperatives investing in, operating, and managing markets;

- Organizations assigned to manage market infrastructure assets including:

+ Entities assigned market infrastructure assets managed by the provincial level: Public non-business units; enterprises with 100% state-owned charter capital (hereinafter referred to as state enterprises); provincial specialized agencies for market infrastructure assets.

+ Entities assigned market infrastructure assets managed by the district level: Public non-business units; communal People's Committees; district specialized agencies for market infrastructure assets.

- Organizations carrying out the exploitation of market infrastructure assets as stipulated in Articles 24 and 25 of Decree No. 60/2024/ND-CP.

Market infrastructure assets (including land and assets attached to land) invested and managed by the State include:

- Market sheds and roofed constructions, management offices of market operating organizations within the market area, sanitation areas, goods storage warehouses, parking lots, waste collection and treatment areas, security rooms, religious spaces (if any), and cold storage rooms (if any);

- Technical systems including: transportation infrastructure systems, water supply and drainage systems, electric power systems, information systems, surveillance camera systems, ventilation and air conditioning systems, fire prevention and control systems, waste collection systems;

- Other constructions within the market area.

Regulations on market management organization's rights and responsibilities

Pursuant to Article 9 of Decree No. 60/2024/ND-CP, market management organizations have the following rights and responsibilities:

- Organize, implement market management and service activities serving market operations in accordance with Decree No. 60/2024/ND-CP and relevant laws.

- Conduct renovation, upgrading, maintenance, and repair of the market as per regulations; ensure fire prevention and control, environmental sanitation, water resource protection, public order, food safety, and measurement within the market and business areas.

- Develop Market Regulations, organize the operation of the market in accordance with Market Regulations, and handle violations of Market Regulations within their authority. According to Article 10 of Decree No. 60/2024/ND-CP, Market Regulations include the following main contents:

+ Opening hours;

+ Rights and obligations of merchants operating in the market;

+ Regulations on goods and services traded in the market;

+ Regulations for individuals conducting transactions, purchasing, selling, visiting, or performing official duties at the market;

+ Regulations for market management staff and employees;

+ Fire safety and disaster prevention;

+ Security and order at the market;

+ Environmental sanitation and food safety;

+ Civilized market conduct, code of conduct;

+ Requirements for organizing and participating in cultural and social activities at the market;

+ Regulations on handling violations at the market;

+ Other regulations.

- Sign and execute contracts with merchants regarding the rental and use of business points at the market and other services as per legal regulations.

- Disseminate and inform merchants operating in the market about relevant policies and laws.

- Coordinate with competent authorities in implementing regulations on the prevention and control of infectious diseases.

- Compile and report on market activities as required by competent authorities.

- Maintain market operations to ensure trading and exchanging of goods under normal conditions and as required by competent authorities when necessary.

- Besides the above-mentioned obligations, market management organizations as stipulated in Clauses 1, 2 of Article 15, Articles 24 and 25 of Decree No. 60/2024/ND-CP have the responsibility to manage and use public assets according to legal provisions.
