The content of the article presents the regulations on issuing electronic ID cards from July 01, 2024, based on the current legal provisions in Vietnam.

On June 25, 2024, the Government of Vietnam issued Decree 69/2024/ND-CP regulating the issuance of electronic ID cards.

Regulations on the issuance of electronic ID cards from July 01, 2024 in Vietnam

In Article 28 of Decree 69/2024/ND-CP, the regulations on the issuance of electronic ID cards in Vietnam are as follows:

- Electronic ID cards are presented in the form of a feature, an utility of the national identification application through accessing a person's electronic identification account.

- Electronic ID cards are issued along with the issuance of a level 02 electronic identification account for Vietnamese citizens and carried out according to the procedures specified in Article 10 of Decree 69/2024/ND-CP.

- The use of electronic ID cards through accessing citizens' level 02 electronic identification accounts is considered equivalent to using citizen ID cards, which are still valid for administrative procedures, public services, transactions, and other activities.

- Electronic ID cards are permanently stored in the electronic identification and authentication system. The history of electronic ID card usage is stored in the electronic identification and authentication system for a duration of 05 years from the time of use.

- The Minister of Public Security specifies the form of electronic ID cards on the national identification application.

Procedures for locking electronic ID cards from July 01, 2024 in Vietnam

To be specific, in Article 29 of Decree 69/2024/ND-CP, the procedures for locking electronic ID cards are as follows:

- The electronic identification and authentication system automatically records, checks, authenticates, and locks electronic ID cards in cases specified in points b, c, d Clause 1 Article 34 of the Law on ID Cards 2023. The recording is done by updating information into the electronic identification and authentication system specified in Article 8 of Decree 69/2024/ND-CP.

- Individuals who are issued electronic ID cards can request to lock their electronic ID cards directly at the commune, ward, or commune-level town police station or the provincial or district-level ID management office closest to them or through the national identification application using form TK03 issued with Decree 69/2024/ND-CP. The ID management authority is responsible for recording, checking, authenticating, and locking the electronic ID cards immediately after receiving the lock request from the citizen on the electronic identification and authentication system.

- Law enforcement agencies and other competent authorities send a request to lock electronic ID cards to the commune, ward, or commune-level town police station or the provincial or district-level ID management office closest to them for reception and processing.

- Within 01 working day from the receipt of the request to lock electronic ID cards from law enforcement agencies or other competent authorities, the commune, ward, or commune-level town police station or the provincial or district-level ID management office receiving the request must consider and transfer the lock request to the head of the ID management office of the Ministry of Public Security for consideration and approval through the electronic identification and authentication system.

- Within 02 working days from the receipt of the proposal from the commune, ward, or commune-level town police station or the provincial or district-level ID management office, the head of the ID management office of the Ministry of Public Security will consider and approve cases requesting to lock electronic ID cards as specified in Clause 2 Article 29 of Decree 69/2024/ND-CP and notify the requesting agency and citizens. If the request to lock electronic ID cards is denied, a written response with an explanation is provided.

Latest procedures to unlock electronic ID cards in Vietnam

In Article 30 of Decree 69/2024/ND-CP, the procedures to unlock electronic ID cards are as follows:

- The electronic identification and authentication system automatically reviews, checks, and unlocks electronic ID cards when there is no longer a basis for locking the electronic ID cards.

- Individuals with locked electronic ID cards can request to unlock their electronic ID cards directly at the commune, ward, or commune-level town police station or the provincial or district-level ID management office closest to them or through the national identification application using form TK03 issued with Decree 69/2024/ND-CP. The ID management authority is responsible for recording, checking, authenticating, and unlocking the electronic ID cards immediately after receiving the unlock request from the citizen on the electronic identification and authentication system.

- Law enforcement agencies and other competent authorities send a request to unlock electronic ID cards to the commune, ward, or commune-level town police station or the provincial or district-level ID management office closest to them for reception and processing.

- Within 01 working day from the receipt of the request to unlock electronic ID cards from law enforcement agencies or other competent authorities, the commune, ward, or commune-level town police station or the provincial or district-level ID management office receiving the request must consider and transfer the unlock request to the head of the ID management office of the Ministry of Public Security for consideration and approval through the electronic identification and authentication system.

- Within 02 working days from the receipt of the proposal from the commune, ward, or commune-level town police station or the provincial or district-level ID management office, the head of the ID management office of the Ministry of Public Security will consider and approve cases requesting to unlock electronic ID cards as specified in Clause 2 Article 30 of Decree 69/2024/ND-CP and notify the requesting agency and citizens. If the request to unlock electronic ID cards is denied, a written response with an explanation is provided.
