On June 27, 2024, the Minister of Home Affairs issued Circular 05/2024/TT-BNV regulating standards, conditions for promotion to rank II and rank I for administrative public employees, clerical public employees, archival public employees; salary classification for newly recruited or received public employees.

Guidelines for Salary Classification for Individuals Recruited and Admitted as Public Employees from December 7, 2023 in Vietnam​

Based on Article 4 of Circular 05/2024/TT-BNV guiding the salary classification for newly recruited or admitted public employees from December 07, 2023, as follows:

(1) In cases where salaries are classified according to state-regulated salary tables, salary classification corresponding to each case of newly recruited or received public employee is implemented as follows:

- In cases where salaries are classified according to the professional, occupational salary tables of officials or public employees as stipulated in Decree 204/2004/ND-CP (amended and supplemented in Decree 76/2009/ND-CP, Decree 14/2012/ND-CP, Decree 17/2013/ND-CP, and Decree 117/2016/ND-CP), it is implemented according to the guidelines in Clause 2 Section II of Circular 02/2007/TT-BNV guiding salary classification when upgrading, changing ranks, and changing types of officials and public employees;

- In cases where salaries are classified according to the military officer rank salary tables of the People's Army or the Professional Non-commissioned Officers and Technicians of the People's Public Security Forces, or the cryptographic work-specific salary tables, it is implemented according to the guidelines in Clauses 6 and 7 Section III of Circular 79/2005/TT-BNV guiding the reclassification for officials and public employees when changing jobs and for cases shifted from the armed forces, cryptographic sector, and state enterprises to work in state agencies and public service providers of the State;

- In cases where individuals hold managerial positions in state-owned enterprises classified according to the salary coefficient of dedicated company managers stipulated in Decree 52/2016/ND-CP regulating salary, remuneration, bonus for managers of one-member limited liability companies wholly owned by the State, it is implemented according to the guidelines in Circular 13/2018/TT-BNV amending Clause 8 Section III of Circular 79/2005/TT-BNV.

(2) In cases where salaries have been classified according to state-regulated salary tables, afterwards transferring to the private sector (without receiving a lump-sum social insurance allowance) and having mandatory social insurance contributions while working, the salary classification corresponding to each case of newly recruited or received public employee is implemented as follows:

Based on the salary coefficient at the time of transfer to the private sector and the mandatory social insurance contribution time after moving to work in the private sector, calculated for every 03 years (36 full months) for those appointed to public employee positions classified from type A0 or above, or every 02 years (24 full months) for those appointed to public employee positions classified type B, one salary step or above-scale seniority allowance (if applicable) is granted; the months not sufficient for 36 months (for public employees classified from type A0 or above) or 24 months (for public employees classified type B) will be counted towards the time for the next salary step increase or seniority allowance consideration (if applicable).

(3) In cases where individuals have service time subjected to mandatory social insurance contributions according to legal regulations and do not belong to the categories in (1) and (2), the salary classification and determination of equivalent service time to retain the rank when appointed upon recruitment or reception are implemented as follows:

- Regarding salary classification:

Based on the total duration of salary subjected to mandatory social insurance contributions (if there are non-continuous periods without a lump-sum social insurance benefit, they are combined), minus the internship period as per the prescribed position/ title when appointed upon recruitment or reception; the remaining time is used to classify salary for the designated public employee title as follows: From the first salary step of the appointed public employee title upon recruitment or reception, for every 03 years (36 full months) for those appointed to public employee positions classified type A0 or A1, or for every 02 years (24 full months) for those appointed to public employee positions classified type B, one salary step is granted.

After converting the time to classify salary into the designated public employee title upon recruitment or reception as above, if there are months not sufficient for 36 months (for public employees classified type A0, A1) or 24 months (for public employees classified type B), these months will be considered for the next salary step increase or seniority allowance consideration (if applicable) in the appointed public employee title.

- Determining equivalent service time to retain the rank of the public employee upon recruitment or reception:

If service time is subjected to mandatory social insurance contributions according to legal regulations and is used to classify salaries into the designated rank upon recruitment or reception as regulated in (3), the equivalent service time to retain the rank of the appointed public employee is calculated from the date of obtaining an equivalent or higher educational degree compared to the required position’s qualification upon recruitment or reception.

(4) In cases of newly recruited or admitted public employees and those classified according to regulations in (1) and (2), if during previous service time there were years of work assessed and rated as not completing tasks or disciplined without extending salary increment time according to regulations, the classification time is implemented according to Clause 3 Article 2 of Circular 08/2013/TT-BNV (amended in Clause 5 Article 1 of Circular 03/2021/TT-BNV).
