Recently, the Ministry of Science and Technology of Vietnam issued Circular 35/2014/TT-BKHCN stipulating judicial expertise in scientific and technological activities.
Regulations on sending organizations and individuals to participate in judicial expertise at the Department of Science and Technology in Vietnam (Illustrative image)
Clause 2, Article 10 of Circular 35/2014/TT-BKHCN regulates the appointment of organizations and individuals to participate in judicial expertise in scientific and technological activities at the Department of Science and Technology in Vietnam as follows:
- Upon receipt of a request or recommendation for judicial expertise or recommendation to introduce judicial expertise organizations or individuals, the Department of Science and Technology presides, cooperates with relevant agencies and units to select judicial experts, case-based judicial experts, case-based judicial expertise organizations with relevant experience and expertise matching the content requiring expertise; decides the form of expertise as individual expertise or collective expertise; appoints organizations and individuals to participate in judicial expertise;
- In case the expertise content is not within the state management scope of the Department of Science and Technology, the Department of Science and Technology is responsible for responding in writing to the requester or the requester for expertise regarding the refusal of judicial expertise.
