On October 17, 2014, the Ministry of Transport issued Circular 50/2014/TT-BGTVT on the management of inland waterway ports and berths.
Regulations on Procedures for Granting Inland Waterway Wharf Operation Licenses (Illustration)
Circular 50/2014/TT-BGTVT stipulates the procedures for granting inland waterway wharf operation licenses. The wharf owner shall submit 01 (one) dossier requesting a license for inland waterway wharf operation directly or via the postal system or other appropriate forms to the Department of Transport. The dossier includes:
- The application form for the inland waterway wharf operation license and the application form for the river-crossing passenger wharf operation license;- Approved technical design dossiers or economic-technical construction investment reports; completion dossiers;- Construction acceptance record;- Diagram of the water area in front of the wharf and the channel to the wharf (if any) prepared by the wharf owner;- A copy of the safety and environmental protection certificate of the floating pontoon (if the floating pontoon is used as a bridge);- Document from the competent authority approving temporary use for cases where the wharf is located within the protection corridor of works according to specialized legal regulations.
The Department of Transport shall receive, inspect, and handle the dossier as follows:
- In case of direct submission, if the dossier is complete, a receipt and an appointment for the result will be issued according to the prescribed time limit; if the dossier is not complete as per regulations, it will be returned immediately with guidance for completion;- In case of submission via the postal system or other appropriate forms, if the dossier is incomplete according to regulations, within 02 (two) working days from the date of receipt, the Department of Transport shall issue a document requesting the wharf owner to supplement and complete the dossier;- Within 05 (five) working days from the date of receipt of the complete dossier, the Department of Transport shall issue the inland waterway wharf operation license to the wharf owner according to Form No. 8, and the river-crossing passenger wharf operation license according to Form No. 9 in the Appendix issued together with this Circular.
The validity period of the inland waterway wharf operation license is equivalent to the land use duration granted by the competent authority to the wharf owner or as requested by the wharf owner. In cases where organizations or individuals need to open wharfs for temporary operation to handle construction materials, equipment, and materials for construction projects, factories, or industrial zones, the validity period of the wharf operation license is equivalent to the construction timeline of the project, factory, or industrial zone.
For river-crossing passenger wharfs, in cases where the wharfs on both banks are operated by one owner and within the licensing authority of one agency, the operator of the river-crossing passenger wharfs should submit a request form for a river-crossing passenger wharf operation license, and the competent authority shall issue one license for both ends of the wharf.
In cases where the wharf owner needs a water area for anchoring vehicles to pick up and drop off passengers or handle goods outside the water area of the inland waterway wharf, the required water area should be clearly stated in the application form for the inland waterway wharf operation license. The anchoring and mooring area for vehicles must not be arranged in the channel and within the protection scope of works.
