On September 30, 2024, the Government of Vietnam issued Decree 119/2024/ND-CP regulating electronic payment for road traffic in Vietnam .

Regulations on locking traffic accounts in Vietnam from October 1, 2024

- Locking a traffic account upon the request of the traffic account holder

+ The road usage payment service provider shall lock the traffic account upon the request of the traffic account holder, guardian, lawful representative of the traffic account holder, or as per a prior written agreement between the traffic account holder and the road usage payment service provider, except for the cases stipulated in point b of this section.

+ The road usage payment service provider shall refuse requests to lock the traffic account if the traffic account holder has not fulfilled their debt obligations to the road usage payment service provider or the road traffic payment service provider. Information on the debt obligations to the road traffic payment service provider shall be synchronized from the road traffic electronic payment database management system.

+ The period of locking the traffic account shall comply with the request of the traffic account holder, guardian, lawful representative of the traffic account holder, or as per a written agreement between the traffic account holder and the road traffic electronic payment service provider.

- Locking a traffic account upon the written request of a competent authority as prescribed by law

+ The road usage payment service provider shall lock the traffic account upon the written request of a competent authority as prescribed by law.

+ Immediately after locking the traffic account, the road usage payment service provider must notify the traffic account holder, guardian, or lawful representative of the traffic account holder about the reason for locking the account.

+ The period of locking the traffic account shall comply with the request of the competent authority stipulated in the written request for locking the traffic account or in the written request for termination of the account lock.

Regulations on closing traffic accounts in Vietnam from October 1, 2024

- The road usage payment service provider shall close the traffic account in the following cases:

+ Upon the request of the traffic account holder, guardian, lawful representative of the traffic account holder, and the traffic account holder has fulfilled all obligations related to the traffic account.

+ The traffic account holder is an individual who has died, been declared dead, missing; the traffic account holder is an organization that has terminated operations, gone bankrupt, dissolved according to the provisions of law.

+ Cases of closing the traffic account as per an agreement between the road usage payment service provider and the traffic account holder.

+ The traffic account holder commits any of the prohibited acts stipulated in Article 5 Decree 119/2024/ND-CP or breaches the agreement on opening and using the traffic account with the road usage payment service provider.

+ Other cases as prescribed by law.

- After closing the traffic account, if the traffic account holder wishes to use the traffic account again, they must follow the procedures to open a traffic account as stipulated in Article 11 Decree 119/2024/ND-CP.
