Recently, the Government of Vietnam has issued Decree 95/2020/ND-CP providing guidelines for the implementation of procurement bidding under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership.

Decree 95/2020/ND-CP prescribes the bid evaluation standards, including technical evaluation standards; determination of the lowest price (for cases applying the lowest price method); standards for determining fixed prices (for cases applying the fixed price method); price point determination and comprehensive evaluation standards (for cases applying the combined method between technical and price). The bidding documents must not state any conditions intended to limit the participation of bidders or to create an advantage for one or more bidders leading to unfair competition; must not put forward the requirement that the bidder must have previously signed and executed one or more contracts with a procurement agency of a specific nation or territory, or the bidder must have experience in providing consulting services within the territory of that nation or territory as a criterion to eliminate the bidder.
- Technical Evaluation Standards: Using a point scoring method to evaluate on a scale of 100 or 1,000. Specifically:- Experience and capacity of the bidder: From 10% to 20% of the total points;- Solution and methodology to implement the package: From 30% to 40% of the total points;- Personnel executing the package: From 50% to 60% of the total points;- The total weight of points for the contents specified in points a, b, and c of this clause equals 100%;- The technical proposal is evaluated as meeting the technical requirements when the technical score is not less than 70% (80% for consulting packages with high and specific technical requirements) of the total points and each requirement on experience and capacity, solution and methodology, personnel score is not less than 60% (70% for consulting packages with high and specific technical requirements) of the maximum points for that content.
