Regulations guiding the appointment of inspection ranks in Vietnam

Recently, the Government of Vietnam issued Decree No. 97/2011/ND-CP stipulating inspectors and collaborating inspectors.

According to Decree 97/2011/ND-CP, the appointment of inspectorate ranks is guided as follows:

1. The appointment of inspectorate ranks must ensure the following principles:

  • The appointed person must meet the professional and occupational standards of the inspectorate rank stipulated in Clause 1, Article 32 of the Inspection Law and the standards specified in Articles 6, 7, 8, and 9 of Decree 97/2011/ND-CP.
  • The appointment must be within the correct authority, follow the stipulated procedures, and meet the needs of the job position.

2. Officials shall be considered for appointment to inspectorate ranks in the following cases:

  • Officials holding ranks of specialist and equivalent, principal specialist and equivalent, senior specialist, and equivalent who are working in state inspection agencies and meet the conditions and standards of the corresponding inspectorate rank.
  • Officials who pass the exam to be promoted from inspector to principal inspector or the exam to be promoted from principal inspector to senior inspector.

Military officers of the People's Army, Public Security officers working in the Defense Inspection, Public Security Inspection who meet the conditions and standards for the inspectorate rank as stipulated in Clause 3, Article 5 of Decree 97/2011/ND-CP are to be considered for appointment to the corresponding inspectorate rank based on conditions, standards, and job position requirements.

Authority to appoint inspectorate ranks:

  • Ministers, heads of ministerial-level agencies, chairpersons of the People's Committees of provinces and central-affiliated cities shall consider and appoint inspectors and principal inspectors.
  • The Minister of Home Affairs shall consider and appoint officials to senior inspector rank; the Ministers of Public Security and Defense shall consider and appoint Public Security officers and military officers to senior inspector rank.

The decision to appoint senior inspectors under the inspection departments of ministries, ministerial-level agencies, provincial and central-affiliated city inspection departments must be sent to the Government Inspectorate for monitoring and consolidation.
