Process and Procedures for Disciplinary Actions in Special Cases for Militia and Self-Defense Forces from August 5, 2020

Recently, the Ministry of National Defense has issued Circular 75/2020/TT-BQP stipulating the application of disciplinary forms, sequence, procedures, time limits, statutes of limitations, and the authority to handle disciplinary actions against the militia.

According to the provisions of Article 32 Circular 75/2020/TT-BQP, the sequence and procedures for disciplinary handling in some special cases for DQTV are as follows:

  1. In cases where the violator under authority commits an act of defying orders or has seriously violated the law, the commander must promptly take preventive measures and immediately report to the competent authority.

  2. In cases where the violator does not comply with the disciplinary review, the commander shall, based on the nature and severity of the violation, the recommendations of subordinates, and mass organizations, convene a meeting of the command and the party committee to consider and decide on the disciplinary form within their authority.

  3. In cases of being disciplined with the deprivation of the title of Militia and Self-Defense Force, the unit commander managing the individual being disciplined shall assign personnel and means to transfer the individual and related dossiers to the military command of the commune, the military command of the agency, or the organization where the violator resides (except in cases where the person has been sentenced to imprisonment by a court).

  4. In cases where the obligation to participate in the Militia and Self-Defense Force is terminated but the individual violated discipline during the period of obligation, the locality, agency, or unit that managed the Militia and Self-Defense Force shall proceed with disciplinary review and handling.
