Procedures for suspension of operations of Integrative education development support centers  in Vietnam

On October 05, 2024, the Government of Vietnam issued Decree 125/2024/ND-CP stipulating the investment and operational conditions in the field of education. Decree 125/2024/ND-CP applies to: early childhood educational institutions; independent childcare groups, independent kindergarten classes, independent nursery classes; general educational institutions; continuing education institutions; Integrative education development support centers; specialized schools; colleges conducting vocational education activities for the group of teacher training sectors at college level; higher education institutions; educational quality accreditation organizations; overseas study consultancy service businesses; and other organizations and individuals conducting educational activities.

The suspension of operations of Integrative education development support centers in Vietnam is carried out according to Article 50 of Decree 125/2024/ND-CP as follows:

(1) An inclusive education development support center shall be suspended from operations in one of the following cases:

- Fraudulent activities to establish or obtain permission to establish the center;

- Failing to maintain any of the establishment conditions or permissions as prescribed in Article 48 of Decree 125/2024/ND-CP during its operations;

- Not commencing operations within 1 year from the date of establishment or permission to establish the center;

- Violations of education law provisions leading to administrative penalties at the suspension level;

- Other cases as provided by law.

(2) Regarding authority: The Chairman of the provincial People's Committee decides to suspend operations of public Integrative education development support centers; The Director of the Department of Education and Training decides to suspend operations of private Integrative education development support centers.

(3) The procedure for suspending the operations of Integrative education development support centers is as follows:

- Upon detecting any violations by the center as specified in section (1), the Department of Education and Training organizes an inspection to assess the actual situation of the center, compiles an inspection report, and notifies the center of the violations;

- Within 15 days from the date of notifying the center of the violations, based on the extent of the violations, the Department of Education and Training submits a proposal to the Chairman of the provincial People's Committee to decide on the suspension of operations for public centers or the Director of the Department of Education and Training for private centers.

The decision to suspend the operations of the inclusive education development support center (according to Form No. 10 Appendix I attached to Decree 125/2024/ND-CP) is publicly announced on mass media in Vietnam;

- If, during the suspension period, the cause of the suspension is remedied, the center shall notify in writing, with evidence, to the Chairman of the provincial People's Committee or the Director of the Department of Education and Training. Within 7 working days from the date of receiving the center's notification, the Chairman of the provincial People's Committee or the Director of the Department of Education and Training shall decide to allow the center to resume operations and publicly announce it on mass media.
