Procedures for issuance of licenses to trade in explosives precursors in Vietnam from January 1, 2025

Explosive precursor chemicals are hazardous chemicals directly used to produce explosives, included in the list of explosive precursor chemicals authorized for production, business, and use in Vietnam as issued by the Minister of Industry and Trade.

The Procedures for issuance of licenses to trade in explosives precursors from January 1, 2025, is stipulated in Article 45 of the Law on management and use of weapons, explosives and combat gears 2024 as follows:

- The dossier requesting a business license for explosive precursor chemicals includes:

+ Request document specifying the enterprise's name, address; reason; full name, address, personal identification number or passport number of the legal representative; enterprise establishment decision number or enterprise registration certificate number; fire prevention and fighting inspection and acceptance document number for the explosive precursor storage warehouse; environmental permit number. If the enterprise deals in ammonium nitrate explosive precursor with a concentration of 98.5% or higher, a security and order eligibility certificate number is required;

+ A list of the storage system, ports, and workshops of the business facility and a document permitting the utilization of the facility; a list of specialized transport vehicles and copies of circulation permits; a plan or measures for emergency prevention and response for explosive precursor storage and transportation.

- When the license is lost or damaged, the enterprise must request a reissue of the explosive precursor business license. The reissue request document must state the reasons for the loss or damage and the results of processing. The validity period of the reissued license does not change.

- The business license for explosive precursor chemicals is adjusted in case of changes in enterprise registration content, location, scale, operating conditions, or related organizational information. The request dossier includes: a request document for adjustment; documents and materials proving the content changes. The validity period of the license does not change.

- The above-stated dossiers and request documents are submitted through the National Public Service Portal, the administrative procedure resolution information system of the Ministry of Industry and Trade, or via postal services to the competent authority as prescribed by the Minister of Industry and Trade; in the case of direct dossier submission, the request document must include the full name, personal identification number, or passport number of the contact person.

- Within 05 working days from the date of receiving the complete dossier, the competent authority issues the business license for explosive precursor chemicals; in case of non-issuance, a written response stating the reasons must be provided.

- The business license for explosive precursor chemicals is valid for 05 years.

Conditions for trading of explosives precursors in Vietnam from January 1, 2025

According to Clause 3, Article 43 of the Law on management and use of weapons, explosives and combat gears 2024, the trading of explosives precursors must meet the following conditions:

- Conducted by enterprises established in accordance with the law;

- The location of warehouses, ports, and unloading sites for explosive precursor chemicals must meet safety and security conditions, be equipped with fire and explosion safety equipment, ensure a safe distance from structures and protected objects, comply with environmental protection regulations; organizations, enterprises having storage, using the storage of buyers, sellers, or leased storage under the contract must ensure the quality preservation during the business period; tools and equipment for containing and storing explosive precursor chemicals must ensure quality and environmental hygiene; transportation means of explosive precursor chemicals must comply with the law on transporting dangerous goods; have legitimate documents proving the origin of production, import, or supply of the types of explosive precursor chemicals in business; equipped with control, collection, and treatment equipment for hazardous waste or have a contract for transportation, treatment, destruction of hazardous waste according to the Law on Environmental Protection;

- Have a plan or measures for chemical incident prevention and response approved or certified by the competent authority in accordance with the Chemical Law;

- Managers and personnel directly involved in the trading of explosives precursors must be trained in chemical safety and firefighting expertise.
