This is the main content stipulated in Decree 89/2011/ND-CP amending Decree 87/2009/ND-CP on multimodal transport in Vietnam, issued on October 10, 2011.
Procedures for issuance of international multimodal transport business license in Vietnam (Illustrative Image)
The Procedures for issuance of international multimodal transport business license in Vietnam is stipulated in Article 6 of Decree 87/2009/ND-CP, as amended by Decree 89/2011/ND-CP as follows:
1. Enterprises, cooperatives stipulated in Clauses 1 and 2, Article 5 of Decree 89/2011/ND-CP must submit 01 set of application documents directly at the Office of the Ministry of Transport or via postal service to request the issuance of an international multimodal transport business license in Vietnam. The application documents include:
- An application for the international multimodal transport business license (as per the form in Appendix I).
- A certified copy of the Business Registration Certificate or a certified copy of the Investment License which includes the registration for the international multimodal transport business sector.
- Confirmation of the enterprise's asset value by the financial management authority, State Audit, or an auditing enterprise. In case the enterprise or cooperative does not conduct an audit, it must have equivalent bank guarantees.
2. Enterprises stipulated in Clause 3, Article 5 of Decree 89/2011/ND-CP must submit 01 set of application documents directly at the Office of the Ministry of Transport or via postal service to request the issuance of an international multimodal transport business license in Vietnam The application documents include:
- An application for the international multimodal transport business license.
- A copy of the International Multimodal Transport Business Registration Certificate issued by the competent authority of that country and legalized by the consulate.
- A professional liability insurance contract for multimodal transport or equivalent guarantees.
Within 07 working days from the date of receiving the complete application, the Ministry of Transport of Vietnam will issue the international multimodal transport business license to the enterprise following the form in Appendix III of Decree 89/2011/ND-CP.
The international multimodal transport business license is valid for 05 years from the date of issuance.
Note: In case the application for the international multimodal transport business license is incomplete according to regulations, within 03 working days from the date of receipt of the direct application or the date indicated on the postal stamp, the Ministry of Transport of Vietnam must issue a written response to the enterprise, clearly stating the reasons.
