Procedure for promulgating service fees for services under the State decision list in Vietnam

On December 13, 2007, the Ministry of Information and Communications of Vietnam issued Circular 02/2007/TT-BTTTT guiding the implementation of regulations on the management of postal and telecommunication service charges.

According to the Circular 02/2007/TT-BTTTTwhen enterprises have a need or when the State requires adjusting service rates under the list of State-determined rates, enterprises must prepare a rate adjustment plan dossier to submit to the Ministry of Information and Communications of Vietnam. The rate adjustment plan dossier includes:

- The petition from the enterprise requesting rate adjustment.

- The rate adjustment plan for services, including but not limited to the following contents:

  • Evaluation of the current business situation of the service from the most recent rate adjustment to the time of the proposed adjustment;
  • Projected market fluctuations, the necessity, and basis for rate adjustment;
  • Basis, method, and explanation of cost calculation for services; specific rate adjustment plan for services;
  • Comparison of current rates and proposed adjusted rates with similar service rates in the region and the world (especially compared to ASEAN countries);
  • Analysis of the impact of rate adjustment on enterprises and service users;
  • Proposals for measures to implement the rate adjustment.

For services requiring approval of the rate plan by the Prime Minister of the Government of Vietnam, within 45 working days from the receipt of a complete rate plan dossier as regulated, the Ministry of Information and Communications of Vietnam will review, appraise, seek opinions from relevant ministries, and submit to the Prime Minister of the Government of Vietnam. After the Prime Minister approves the rate adjustment plan, the Ministry of Information and Communications of Vietnam will issue a Service Rate Decision within 20 working days.

For services where the Ministry of Information and Communications of Vietnam issues the Decision:

- For services requiring opinions from relevant ministries, within 20 working days from the receipt of a complete rate plan dossier as regulated, the Ministry of Information and Communications of Vietnam will review, seek agreement from relevant ministries to issue the Service Rate Decision.

- For services not requiring opinions from relevant ministries, within 10 working days from the receipt of a complete rate plan dossier as regulated, the Ministry of Information and Communications of Vietnam will review and issue the Service Rate Decision.
