Notary Office Ceases Operation, What Happens to Certified Documents?

Each working day, Notary Offices receive numerous notarization requests for various types of documents from the public. In reality, many people wonder whether documents will remain valid if the Notary Office that performed the notarization for them ceases operations.

Notarization is the act performed by a notary public of a notarization service organization to certify the authenticity and legality of contracts, other civil transactions in writing, the accuracy and legality, and not contrary to social ethics of the translation of papers and documents from Vietnamese to foreign languages or from foreign languages to Vietnamese, which, according to the provisions of law, must be notarized or voluntarily requested by individuals or organizations.

According to the provisions of the 2014 Law on Notarization, notarized documents take effect from the date the notary public signs and seals them on behalf of the notarization service organization. This means that when a Notarization Office ceases operations, it does not affect the validity of the documents that have been notarized.

According to Clause 4, Article 54 of this law: “In the event that a Notarization Office ceases operations, that Notarization Office must negotiate with another Notarization Office regarding the transfer of notarized records; if an agreement cannot be reached, the Department of Justice will appoint another Notarization Office or a Notary Office to receive the notarized records.” When a notarization office ceases operations, another notarization office or notary office will take over the records according to the agreement or as designated by the Department of Justice.
