To be specific, the handling of violations involving individuals in air transport activities is guided by Circular 85/2015/TT-BGTVT as follows:
- The Civil Aviation Authority of Vietnam issues the first warning immediately after detecting that an individual has not fulfilled or has not fully fulfilled the respective responsibilities stipulated in Articles 11, 12, 13 of Circular 85.
- Individuals in violation will be notified in writing by the Civil Aviation Authority of Vietnam regarding their management, supervision, and direct operation capabilities in air transport activities in cases of non-compliance or insufficient compliance with the second notice from the Civil Aviation Authority of Vietnam on the same issue.
- For individuals holding positions in charge of managing specialized fields approved by the Civil Aviation Authority of Vietnam, in cases of non-compliance or insufficient compliance with the second notice from the Civil Aviation Authority of Vietnam on the same issue, they will be requested to be removed from the approved position.
- For individuals who are aviation employees, in addition to the violation handling methods stipulated in clauses 2 and 3 above, the offending individuals will also be dealt with according to the organization’s regulations and the specific disciplinary policies for aviation employees; suspended or have their licenses revoked according to the law.
- In addition to the handling methods stipulated in clauses 2 and 3 above, other individuals in violation will also be dealt with according to the organization’s regulations.
Refer to the relevant regulations in Circular 85/2015/TT-BGTVT, which takes effect from March 1, 2016.
